Federal Open Market Committee Meets (FOMC) The FOMC met on Tuesday and Wednesday of this week to discuss interest rates given the shaky state of the economy, the mortgage industry and the credit markets. FOMC Cuts The Fed Funds Rates And, as expected, even on the heals of a 3/4 point (.75%) Fed Funds rate drop last week, they dropped the Fed Funds rate again by 1/2 point (.50%) in order to help stimulate the economy. Proposed Change to Section 1031: Exchanges of Subsidized Agricultural Land or Farm Land I previously blogged about the Farm Bill that is currently pending before the United States Congress and the fact that it contains a provision that would affect Section 1031 of the Internal Revenue Code, including the exchange of subsidized agricultural land (ag land) or farm land. Update on the Farm Bill I am pleased to report that the provision mentioned above has been dropped from the Farm Bill and is no longer a concern.

Proposed Change to Section 1031: Exchanges of Subsidized Agricultural Land or Farm Land The Farm Bill that is currently pending before the United States Congress contains a provision that would affect Section 1031 of the Internal Revenue Code, including the exchange of subsidized agricultural land (ag land) or farm land. Essentially, farm land that is subject to the payment of subsidy payments can only be exchanges with other land that is also subject to the payment of subsidy payments. The farmer (investors/taxpayer) could not exchange subsidized ag land for non-subsidized ag land unless the farmer gave up the subsidy. Lobbying Efforts

Proposed Change to Section 1031: Exchanges of Collectibles (Works of Art) The Farm Bill that is currently pending before the United States Congress contained a number of provisions that would affect Section 1031 of the Internal Revenue Code, including the exchange of art work or collectibles. The provision would have essentially prohibited the 1031 exchange of collectibles such as art work. Pending Change Deleted From Farm Bill I am very happy to announce that this provision has been deleted from the Farm Bill and the 1031 exchange of collectibles is still permitted.

Final Update Regarding Proposed Changes to Section 121 I previously posted about a proposed change to Section 121 of the Internal Revenue Code that was included in H.R. 3648 known as the Mortgage Relief Act, and I have a final update and good news regarding this previously pending legislative issue. Proposed Change to Section 121 Deleted From Bill The proposed change to Section 121 that was included in the Mortgage Relief Act (H.R. 3648) has been DELETED from the bill and there are no pending changes to Section 121 of the IRC!

States that do NOT Mirror Section 1031 of the Internal Revenue Code - 01/08/08 03:45 PM
One of the most common misconceptions is that a tax-deferred exchange pursuant to Section 1031 of the Internal Revenue Code means that all taxes are deferred. This may not be true. It depends on the state that either you or your relinquished property or replacement property are located in. It also gets trickier as more and more investors are 1031 exchanging into different states. California's Franchise Tax Board has routinely taken the position that if you sell and 1031 exchange out of a California investment property and acquire like-kind replacement property in another state you will owe taxes upon the ultimate disposition
