Senate Bill SB 1007 Becomes Law
State of California Governor Arnold Schwarzenegger signed Senate Bill SB 1007 into law on October 2, 2008.  This Senate Bill SB 1007 provides certain minimum standards or guidelines that 1031 exchange Accommodators or Facilitators must meet in order to do business in the State of California as a 1031 exchange Qualified Intermediary. 
Effective Date
This new law is effective January 1, 2009 and must be complied with if a company or individual is doing business as a 1031 exchange Qualified Intermediary within the State of California.

1031: Tax Changes Coming: Combined 1031 Exchange and 121 Exclusion Strategies Affected - 07/24/08 11:55 AM
The Housing Bill currently contains a little known change that could affect the way real estate investors combine a 1031 exchange with a 121 exclusion.  It all depends on how the final law is written or drafted, but the U.S. House of Representatives passed the Housing Bill this week and it has now been forwarded to the U.S. Senate for consideration.

We hear this comment all the time.  It is usually more of a plea or in a state of panic than a comment or question.  The 45 calendar day deadline to identify your like-kind replacement property is a very short window of time.

I addressed safe harbor reverse exchange structures in my last blog post.  I will go into more detail as to how a non-safe-harbor reverse exchange might be structured in today's market.
Deciding On Reverse Exchange Structure
Reverse exchanges structured pursuant to Rev. Proc. 2000-37 must be structured differently from those that are structured using a non-safe-harbor reverse exchagne structure.  You must decide up front if you will be able to follow the safe harbor guidelines or if you will most likely not be able to stay within the 180 calendar day deadline and will need to proceed with a non-safe-harbor reverse exchange.
