The number of first time test takers for the Florida State exam in January 2012 for Sales Associates is 767. The number of students who passed the test the first time is 369, leaving 398 failing the exam. In January of 2012, there were 942 retakes on the state exam and only 307 of those retaking the exam passed.Overall, in January 2012 there were 1709 exams given, and out of those exams 676 people passed and 1,033 failed. Brokers may place funds into an interest-bearing escrow account only if all parties to the transaction give written consent. Rule 61J2-14.014 states that the written agreement must indicate consent to placing the escrow money into an interest-bearing escrow account, designate the party to receive the interest, and specify when the accrued interest is to be disbursed. As the New Year begins, key indicators suggest most of the housing market continues to be in a stabilization and recovery mode. Compared to a year ago, the total for-sale inventory is down by -23.2 % on the national level, declining in 145 of the 146 markets tracked by Realtor.com. The national median age of the inventory is down -4.8% compared to January 2011. While U.S. median list prices declined for the second month in a row, this decline appears to be largely seasonal; on a year-over-year basis, the U.S. median list price was also up 3.69% in January. The FREC will not issue an EDO if the funds are held in an attorney's escrow account or are being held by a title company. An EDO procedure is only available if the funds are held in a brokerage escrow account. If the broker is informed in writing that the Commission will not issue an EDO, the broker must utilize one of the other settlement procedures. In such an instance, the broker must notify the Commission which settlement procedure will be used. Chapter 718, F.S., establishes procedures for creating, selling, and operating condominiums. The law requires that the developer give a disclosure statement to buyers stating that the buyer may cancel the contract within 15 calendar days of signing the contract or of receipt by the buyer of the condominium documents, whichever is later. The Department of Financial Services is the state depository for abandoned property. There is a five-year waiting period for turning over abandoned property. However, real estate brokers can petition to have the Department of Financial Services accept abandoned escrow funds sooner. Brokers who have searched diligently to locate the owners of escrowed funds may contact the Unclaimed Property Office, Department of Financial Services, for instructions on how to proceed.

Brokers must keep business records, books, and accounts in compliance with Florida law and Commission rules and make them available for audit or spot checks by the DBPR at any reasonable time during regular business hours. Records must be preserved for at least five years from the date of any executed agreement, oral or written. The broker must preserve at least one legible copy of all records pertaining to the real estate brokerage business regardless of whether trust funds were involved. If records have been the subject of litigation the broker must retain those records for at least two years (1 comments)
Conflicting Demands - 03/18/12 01:03 PM
Conflicting demands occur when the buyer and seller make demands regarding the disbursing of escrowed property that are inconsistent and cannot be resolved. If a broker who maintains an escrow account receives conflicting demands on escrowed property, the broker must notify the FREC, in writing, within 15 business days of receiving the conflicting demands.Further, the broker must institute one of the four settlement (or escape) procedures within 30 business days from the time the broker received the conflicting demands. For example, if a broker waits 10 business days to report the conflicting demands, the broker has just 20 business days (0 comments)
Rule 61J2-24.002 provides that a broker may be issued a citation if the broker fails to properly reconcile an escrow account even though the account balances. Rule 61J2-24.002(dd) states that the broker is subject to a $500 citation. A citation may be issued only when the account balances. Any shortage, regardless of how small, results in a case against the broker. Cases are prosecuted through the Commission's regular disciplinary process.

Occasionally a licensee may be given a postdated check (considered a promissory note) as an earnest money deposit. Although Florida statute (see F.S. 673) provides for checks and other negotiable instruments to be postdated, the broker should use extreme caution in handling such deposits. The seller'sapproval must be obtained before accepting the postdated check and the fact that the check is postdated should be noted on the purchase and sale contract. Florida real estate license law mandates the time frame for depositing escrow funds. Sales associates who receive a binder deposit from a customer or a principal must deliver it to their broker-employer immediately, which means no later than the end of the next business day. When a sales associate or an employee (such as a receptionist) of the brokerage company accepts funds on behalf of the brokerage company, the broker is accountable for those funds. Escrow funds cannot be commingled with the broker's personal funds or operating funds. Commingling funds is the illegal practice of mixing a buyer's, seller's, tenant's, or landlord's funds with the broker's own money or of mixing escrow money with the broker's personal or brokerage funds. An escrow account, therefore, is associated with the type of monies held in the account. What makes an account an escrow account is that the account is used to hold funds belonging to anyone other than the broker. I would have to say that one of the latest things we have done to be more efficient in our business is download evernote on our computers. We create Shared Notebooks for all of our important data It’s easy when I am away from the office teaching to drop something into Evernote and know that anyone that has access to it will see it. It is great for storing information you want access to quickly. I can be away from the office and log into my evenote and access log in information needed for student (5 comments)
