If the brokerage firm has a transaction broker relationship with the seller, the brokerage firm can also work with the buyer, in the same transaction, as a transaction broker or in no brokerage relationship.

Under Florida law, it is presumed that all licensees are operating as transaction brokers unless a single agent or no brokerage relationship is established, in writing, with the customer.
A transaction broker is a broker who provides limited representation to a buyer, a seller or both in a real estate transaction, but who does not represent either party in a fiduciary capacity or as a single agent.   In a transaction broker relationship, the seller or the buyer is called a customer, not a principal.  The (customer) is not responsible for the acts of a licensee. One of the best sources of buyers is past customers and clients because they already have enjoyed the benefits of the sales associates service.  Agency representation may be a problem, however.  If the sales associate listed a client's property in a prior relationship, the person may feel that the same agency relationship exists in the purchase of a new home.  The sales associate must give the buyer the appropriate brokerage relationship disclosure.

In a transaction broker relationship, the seller or the buyer is called a customer, not a principal.
In a transaction broker relationship the (customer) is not responsible for the acts of a licensee. Transaction brokers may represent both buyer and seller in a real estate transaction.Chapter 475 defines customer to mean a member of the public who is or may be a buyer or a seller of real property and may or may not be represented by a real estate licensee.

Fiduciary is a person in a position of trust and confidence with respect to another person.  A Fiduciary relationship is an alliance of trust and confidence that creates a moral and legal obligation when extended by one person and accepted by another.The agency relationship creates a fiduciary relationship with the principal.  a fiduciary acts in a postilion of trust or confidence for another.  A fiduciary owes complete allegiance to the principal.  A fiduciary relationship contrasts with the common pubic relationship that exists in normal trading transactions where people with adverse interests deal at arms length with one another.
