All too often in real estate we focus on the sensational stories and neglect the most obvious abuses of mortgage fraud.  Since fraud is involves stealing something that's not yours there are many ways to take something that you are not entitled to.  It starts with deception, and ends with the possession of ill gained goods.  Since short sales en-masse are so new, everyone assumes the process is transparent and legal.  I am taking the position it isn't, and it is mired in deception and fraud.

There is an old saying that says "Ice Cream has No Bones!"   It does not mean anything but in real estate we are inundated with nonsense everyday in negotiations.  Slight of hand works great in a magic show, but not in contact negotiations where it paves the way for fraud and deception.  Despite our own innermost warnings, we have become so numbed to gibberish and doubletalk we sometimes move forward into a deal that we should not.  Such actions redefine the word "Trust" and only can be likened to the wolves gaurding the sheep.  New homes builders seem to abuse this issue … (8 comments)

In many real estate markets some listing agents think they are clever advertising ‘pre-listings', or the latest one I've seen on some yard signs as a rider that says "coming soon!"  Upon further investigation, you'll find these listings are not entered into the MLS system.  Under most state real estate license boards it is illegal to advertise a property for sale where the listing agreement has not yet been signed. Implied representation is deceptive and fraudulent.  For most Realtors® and MLS board members there is an agreement and understanding that all participating brokers will place all their listings into the MLS systems, and … (214 comments)

I just finished reading a news story that broke within the last hour.  The story talks about an insurer company that wants to buy a bank so they can qualify for government aid!  The story mentions that Hartford Financial Services wants to purchase a Florida based Federal Trust Bank for 10 million dollars so it would make the insurer a Federally insured savings and loan bank!  When recognized as a bank...the company will be eligible to apply for Federal assistance.  If the Insurers plan works and they become a bank - they will be eligible for up to 3.4 billion dollars.  Sounds like 'wolves … (32 comments)

Every agent in real estate occasionally is blessed to sell a home and get both sides of the deal, but what about the agent that does this all the time?  There is something wrong with this.  I'm sorry, but the longer I am in real estate the one thing that gets me crazy are unethical agents. This will go down in my personal history books as the year I do not want to repeat.  I get sick of turning on the news, or reading business news on the internet and learning of historic failures of banks, companies and yes bailouts.  What bothers me most is the piece meal bailouts.  This bank is too big to fail so we must buy them out.  My fear?  Cronyism.  Maybe one bank gets bailed out because they play political favors with politicians and another doesn't.  Sort of like Countrywide Mortgage.  No indictments, no investigations.  That bothers me a lot.  Yesterday's big … (52 comments)
