WHAT ARE THE BUYERS SIGNING?

I believe the number one reason a client works with a particular agent is because they trust him/her, or should they? We are not attorneys, but there are simple dates and terms we should make sure are part of a contract.

Let's take for example the Short Sale Addendum to Purchase and Sale Contract from the Florida Association of Realtors. Paragraph 1- Has the approval deadline and either party may cancel the Contract. However, it does not state that the Deposit needs to be returned to Buyer.

I recently received a Short Sale Addendum for my clients to sign prepared by an Attorney who is also the Closing Agent. Please note this was the only addendum to the contract and it also stated that this Addendum shall prevail if there was a conflict between this Addendum, the contract or any other addendum. As I read the Addendum I noticed that the following important terms were missing:

(1) Approval Deadline for Lender, without this deadline we have a contract that is open indefinitely pending for a certain contingency to clear. If the buyers get tired of waiting for the Lender's approval how do you get out of this contract? Remember it is a contract and there is a contingency for Lender's approval.

(2) Time Periods: Due to the complexity of the Short Sale Transaction and the time limits, the addendum should have a Time Period (EFFECTIVE DATE OF THE CONTRACT). In any short sale addendum we should have this time period start when the Lender approves the Short Sale, otherwise by the time the Lender approves the Short Sale your inspection period, commitment letter, and closing date would have elapsed.

When I spoke to the Listing Agent regarding the addendum he said that that was the addendum this Attorney had been using till now and had no issues with it.

My question to him was- So when does this contract become effective?

He said- When the Lender approves it

I said- we both agree on that, so where in the contract or addendum does it state that?

He said- I will speak to the attorney.

Many important dates and addendums are not taking seriously by many agents. They just want the deal signed and the house sold. I want that to, but done the right way.

Buyers are interested in purchasing your house, not your pets

I just showed a beautiful property to prospective buyers. As soon as the listing agent opened the door the smell of dog was unbearable. I am an experienced agent, and even I could not concentrate on the beautiful details of the home due to the horrible smell.

I love pets and I understand they are a part of the family. However, buyers are interested in your home and the same should be staged and ready to attract any buyer. Not all buyers are pet lovers and even if they are, they should imagine themselves in that house with their pets, not yours.

It is a very good idea to leave your pets with a neighbor, a family member or take them for a walk while your home is previewed. You should make sure there is no trace of your pet, and please don't forget to put away their water and food trays, the buyers are concentrated on other details and may even trip over them.

The focus right now is on selling your house, once that is accomplished you can continue living your normal life with your family, and the adorable and loved family pet.

HOW LONG IS A BPO GOOD FOR?

In this constantly changing market HOW LONG IS A BPO GOOD FOR? I am currently negotiating short sales, and have noticed that Lenders are sticking to their 2 month old BPO, and requesting a net to them pursuant to the percentage of that BPO.

I find myself faxing to them the recent active short sales, pending and closed sales with an explanation of why the buyer will not increase their offer, but I guess as a Listing agent my BPO means nothing to them.

I also prepare BPO'S and I am very conservative when it comes to pricing due to the current market conditions (take a look at the whole picture). Do BPO agents think they can impress the Lenders by providing a high BPO to get this listing? At the end they are hurting these lenders, the longer a property stays in the market, the more money these lenders will lose.

7/14- Just spoke to a negotiator for EMC mortgage and asked the question. HOW LONG IS YOUR BPO GOOD FOR? His answer- 6 months!!!!!!! Good luck to them and all of those Lenders with the same guidelines.....

A SUCCESSFUL SHORT SALE WITH HOMEQ SERVICING

I have had a great experience with HomEQ during my negotiations of a short sale request. My phone calls were answered immediately, their files were up to date with all the paperwork I had faxed to them, the negotiators were courteous and helpful on the phone. They understood that the subject is located in a very active foreclosure and short sale subdivision so the discount was deep.

The short sale was approved today to close by July 18. That will be no problem on the buyer side since this is a cash offer. However, Bank of America the second mortgage had already approved the sale, but since HomEQ is taking a big hit they lowered the net to Bank of America. I contacted Bank of America immediately and to my surprise I have to send the entire file again for reviewing, a simple revised preliminary HUD was not good enough.

Now, I am trying to understand this- Lets continue to waste valuable time, paper and ink to receive the same information I sent you a month ago.

I hope I can get Bank of America to review quickly. Every time I would contact them before I had to wait 5 to 10 business days for the information to appear in their system.
