Kahala Avenue Homes with Statue Gardens & Museum - Part 2 of Kawamoto's "Kahala Avenue Mission"

Japanese billionaire Genshiro Kawamoto, aged 79, is making headlines yet again, and causing quite a stir on Oahu, particularly in the prestigious luxury home neighborhood of Kahala on Oahu. Kawamoto is known to be a little eccentric, bizarre even, and is not favored by many Kahala residents. Kawamoto has been the subject of a lot of negative media coverage over the years with communities and neighborhood boards registering complaints and even individual lawsuits against the real estate tycoon.

Kawamoto first hit the Hawaii real estate scene in the late 80's during what is known as the "Japanese bubble." At this time, the US dollar was down and many foreign investors, especially the Japanese, were buying up high-end luxury Oahu real estate in a frenzy. Kawamoto aquired many properties in the period 2002-2006, and now owns more than 20 luxury homes on Kahala Avenue, most purchased for between $2 and $10 million. Kawamoto went on to purchase, in September 2010, an impressive acre and a half beachfront estate at 4653 Kahala Avenue with a price tag of $22 Million. He had already brought the property next door and also another just down the road. In 2010, he also put several of his Kahala homes for sale on the market. Currently, only one of his Kahala luxury homes is listed, 4767 Kahala Avenue, for $3,200,000. Kawamoto is said to own approximately 200 single family homes and condominiums in Hawaii.

You may recall, Kawamoto was frequently in the news in 2007 when Kawamoto announced that he would provide low income Hawaiian families with the opportunity to live in five of the luxury Kahala homes that he owns on Kahala Avenue. Ultimately, he moved three local families into these Kahala Avenue homes, for very low ($150/mo) or no rent, with a 10 year lease. He tore down fences on these homes to enhance the sense of community and filled in swimming pools to make the homes safer for children. All this was supposedly part of his plan called the "Kahala Avenue Mission." Kawamoto has said that he wanted to bring more people to Kahala Avenue and that he wanted more native Hawaiian families to visit the area, to make Kahala "more fun." The rest of his homes appear to have remained vacant and many have fallen into disrepair and were graffitti-ed, which has angered his neighbors in this multi-million dollar luxury neighborhood of Kahala.

Now, apparently, the next phase of Kawamoto's "Kahala Avenue Mission" is to turn clusters of his properties into a statue garden, Japanese tea house and a museum to hold a European Art collection. Again, his plans are causing great upset with the Kahala neighborhood board who oppose his plan and are again accusing Kawamoto of disrupting the community. In August 2010, Kawamoto was interviewed by Hawaii media and stated he would be making improvements to many of his properties and asked for the community to "wait a little longer, there will be more improvements." I wonder what else is in store??

What is A CPR? - CPR Homes in Hawaii - CPR Homes versus Single Family Homes

WHAT IS A CPR?

Did you know ... Hawaii was the first state in the United State to condominiumize?? It is no wonder considering the hundreds of highrise apartments buildings and spectacular ocean views in every direction that we have here, on Oahu. In the 1960's lawmakers essentially figured out a way to sell the air space above a particular piece of land, in apartment building highrises, by creating what was known then as a Horizontal Property Regime (HPR) and what is now called a Condominium Property Regime (CPR).

So, in its simplest form, a CPR is two or more condo units - a condominium (condo) is basically a single apartment dwelling with common elements on a property shared with one or more other apartments. A CPR is created by registration and filing of a master deed or lease, declaration, by-laws, plans and public report with the State of Hawaii and approval of the project by the Hawaii Real Estate Commission enables the developer to sell the apartments in the CPR.

When you purchase an apartment in a high-rise, the building and its grounds are typically a CPR and you are buying a condo or apartment within the CPR. (Note, however, apartments can also be a part of co-op or condotel). Most of the time, however, the apartment is a condo and to sell the condo, the developer or subsequent owner of the building must have officially created the CPR.

Condominium law is also used to circumvent subdivision laws. Sometimes a single family house is a condo. Usually these are called "CPRs" or "CPR homes." This means that the single family home is part of a condominium property regime. The condos in a CPR may be attached to one another (as in an high-rise apartment) or detached (as in a single family home subdivision). You can tell if a property is part of a CPR by looking at its TAX MAP KEY (TMK). A TMK is a number like 1-4-2-030-045-0000. If the TMK ends in 4 zeros it is NOT part of a CPR. If the TMK ends in any other number, e.g., 1-4-2-030-045-0017, then the property is part of a CPR.

A CPR is usually created with respect to single family homes when the particular property that the owner/developer wants to divide is of a nature that cannot meet the regular subdivision requirements. For example, subdivision law requires that properties have a particular access or street frontage, or certain space or setbacks between properties, etc. On a narrow lot, for example, it may be impossible to divide the property in such a way to comply with subdivision law because you could never have an access road of legal width and still have room to build. In this case, if the property is large enough to meet zoning laws for occupancy and multiple residences, a CPR can be created. Notably, the lots do not have to be split equally by the number of apartments created. They are split however the developer wants to split them.

Like a highrise CPR project, a single family CPR will have common elements. There may or may not be monthly maintenance fees and shared expenses. Usually, there is some kind of shared access. There may also be a shared wall or walls. A CPR could also be done by stories in a building. But any way it is configured, the minimum lot size requirement for two dwellings must be met, depending on the zoning of the property.

CPR Homes are often, but not always, on relatively smaller sized lots. For example, it is common to see 8,000-10,000 sq ft lots CPRed in areas where there is R-5 zoning.

There are other practical reasons to create a CPR. One benefit of CPR-ing or Condominiumizing a property is that it allows the individual owners of each apartment in the CPR to have a separate mortgage. This can be important for multi-family or mulit-generational properties, to protect the individual property owners from the default of one of the others. For example, parents may allow their children to build another home on their property and take a mortgage on the property for financing of the construction. By condominiumizing, the parents can ensure that the children are on a separate mortgage for the property and that their security in their home and property is not jeopardized in the event that the child defaults.

15 Pueohala Place, now listed for $3,000,000 (a $295K reduction).

I know, it still sounds like a lot on money, but to get Kailua Beach, BEACHFRONT for $3,000,000 or under these days is rare. This Kailua Oahu Beach House is a best buy!!

There have been only 3 sales for Kailua Beachfront Homes at $3M or under since 1/1/2006.

350 Dune Circle sold for $2,880,000 in October 2010. (#2 on Map, Below) This Kailua Oahu Beach House was 4BR/3BA and 2,644 sq ft on a 13,153 sq ft lot. The home was a tad bit dated and the floor plan seemed a bit cramped for its size. Also, the home was situated right next to the public beach access, making it less quiet and less private than the Pueohala home. It did have a nice large front entry space and was on Dune Circle which is a great little Kailua subdivision with Hawaii luxury homes, in the Beachside neighborhood of Kailua, with wide streets and several other well-kept Oahu beach homes and some non-beachfront homes, as well.

21 Pilupu Place sold for $3,000,000 in September 2009. (#4 on Map, Below) This Kailua Oahu Beach House was 4 BR/ 4.5 BA and on a 3,008 sq ft. lot. This was a pretty funky, not so little home, with a lot of Lava Rock and a pretty much indoor/outdoor living room, in the camping out sort of way. Well, there is no really nice way to say it other than this Oahu beach house needed a complete renovation!

21 Pilipu Place. Oahu Beach Home in Kailua. Sold $3,000,000. 9/2009

40 Kaapuni, #1 sold for $2,800,000 in January 2006. (#3 on Map, Below) I did not actually see this Oahu beach house when on the market, but This home was 4BR/4.5BA and 2,753 sq ft on a 10, 913 sq ft CPR lot. What does this Oahu beach house have going for it? Beach frontage, on a nice spot on Kailua Beach. For now, a relatively empty lot next door, so views from every room. (See above.) And, even if next lot is built on, toward the back side by beach, the main living space would retain all views. There is also protected and private pool area (below), not facing beach. Nicely updated. High ceilings for a very spacious feel. Move-in ready.

What makes the Pueohala Kailua, Oahu Beach House a lower price than some others? ... the lot size mainly, as most of the value in almost any Oahu beach house is in the lot. This lot is is 10,000 square feet. Still a healthy size, but smaller than many of the others. On the positive side, there is less space to maintain and pay taxes on. It is not brand-new remodeled (remodeled in 2007) or built (1970 build) but still looks great and has great beach frontage in Kailua.

This makes this Oahu Beach House in Beachside Kailua a "Best Buy" in my book!

Did I Wake Up In an Alternate Universe? Short Sale Response from B of A in 14 Days?

Wow! was all I could say this morning when I checked my email and saw a counter offer from B of A.

I submitted a short sale offer to Bank of America 14 days ago. In the past two weeks, I uploaded all the required documentation, on schedule, including all the homeowner documentation. The BPO was completed two days ago and I got the last required homeowner document in yesterday.... So I was just a little bit suprised to get a response so quickly.

To put this in context, I should tell you that my last short sale with Bank of America, completed a few months ago, took 11 months to close. During this period I managed virtual unresponsiveness from the negotiators, a nervewracking series of 10 or 11 sale postponements, 5 separate negotiators, 2 buyers, dozens of conversations with attorneys and lien holders, multiple series of escalations, and a even a letter to the CEO. Needless to say, it was a nightmare, and to get even an initial response from B of A on the first offer took 4 months.

On this one, we are still not out of the woods, because IF we can make B of A's counteroffer response work with the Buyer, it must still must go to the investor and that could change everything, but I am still practically doing cartwheels at hearing from Bank of America this quickly. I hope I am not speaking to soon, but I guess they are serious about cleaning up their act.

Hawaii No. 11 Nationwide For Foreclosures According to Realty Trac

When it comes to foreclosures, times have changed in Hawaii. Seems like not long ago, I reported that the State of Hawaii was 5th from the bottom in its ranking among the 50 states for rate of foreclosures. Not any more, the rate of foreclosures has been steadily rising over the past few years, up 40% in 2010 from 2009, though obviously lagging behind mainland trends, as is typical for many things over here.

In January, Realty Trac reported that there were 985 properties in foreclosure, or 1 out of every 523 homes. This was actually down from the prior month, and December's statistics reflected a drop from November, as well. Hopefully, this means a start to the reversal of the trend. We can only hope.

Oahu Home Improvements: Cost v. Value when Selling Your Oahu Home

Many people looking to sell their home on Oahu are taking a renewed look at home improvements prior to putting their home on the market. Gone are the days when it was easy to sell any home, regardless of the condition. Home buyers want to see upgrades and homes that are upgraded and priced right are still in higher demand than fixers.

The Honolulu Board of REALTORS recently published a report, courtesy of the Overhead Door Corporation, and using data from Remodeling 2010-2011 Cost v Value Report, listing the Home Improvements with the greatest return on Oahu.

Topping the list in the value to cost comparison were replacing entry (222.7% return on cost) and garage doors (180.8%). Other exterior improvements such as roofing (99.4%), vinyl siding (111.2%), vinyl window replacement (111.2%) and wood decks (125.5%) were also on the Top 10 list. And, of course, minor kitchen remodel (119.8%) and bathroom remodel (108.8%) were on the Top 10 list. All of these improvements reaped a return of almost 100% or more over cost, according to the data.

Protecting Tenants at Foreclosure Act - Tenants Should Know Their Rights to Stay in Their Home

It's amazing how many calls I've received in the past two years from tenants of homes that are being foreclosed. It's not necessarily a realtor's job to answer questions on this subject, but I get this question a lot because I am also an attorney.

Most people don't know that they have rights to stay in the home that they have rented, even at foreclosure, and are worried about what will happen to them upon the foreclosure of the property. The scenario usually goes that a homeowner in distress decides to rent out their property during the period prior to foreclosure. In many cases, it takes several months to a year or more to actually foreclose on a property. The homeowner figures that they might as well get some rent during this period prior to foreclosure. Or maybe it always has been a rental property. In either case, often the tenant will not have any knowledge of the pending foreclosure at the time they sign the lease and their first notice of the foreclosure date is a few weeks prior to the auction date when a notice is posted on their door.

What rights do tenants actually have? Fortunately for them, President Obama enacted the Protecting Tenants at Foreclosure Act of 2009, which has been very helpful to many tenants. This law does several things:

It allows tenants to stay in the home for the term of their lease, even with a new owner, and the tenant may be evicted during this period only for good cause. The exception to this is when the home is sold at or after foreclosure to a new owner-occupant. In that case, the new owner must still give the tenant 90 days notice to vacate and the tenant may not be able to finish out the lease.

In a situation where there is no lease, the tenant may not be evicted without at least 90 days notice. In a month to month tenancy, the tenant may not be evicted without at least 90 days notice. In all cases, tenants must continue to pay rent and uphold other terms of the lease agreement.

There are some cases where the law does not apply. For example in the case where the tenant is not a "bona fide tenant" or the lease is not a "bona fide lease," and where the lease transaction is not an arms length transaction.

Honolulu and Oahu Real Estate on the Upswing in 2010!

Recently, the Honolulu Board of REALTORS published its annual report and compilation of all the past year's housing statistics. Fortunately, the news is GOOD!

The Honolulu Housing Report for 2010 showed that the market as a whole had improved, in terms of increases in the number of homes sold, and in both median and average prices, and decreases in average days on the market. The Honolulu Housing Report breaks down activity by community and uses graphics for a more detailed look at things.

While news is good, the positive 2010 report reflects things such as low interest rates and the tail end of the buying spree generated by the First Time Homebuyer Credit in 2008-2009. What remains to be seen is how the 2011 market will do with modestly increasing interest rates and no Home Buyer credits on the horizon. There is also the issue of increasing supply of foreclosed properties and continuing short sales. Though, that might be a good thing since exisiting inventory is now a bit low and it would be good to have some extra homes on the market to take care of current buyers.

My guess is that we will continue to see improvements in 2011, though perhaps not quite as good as in 2010.

5. Oahu Real Estate for Sale is Organized into a Centralized MLS (Multiple Listing Service) - The public has access to ALL the Oahu properties in the MLS just by visting the Oahu MLS Public Website www.hicentral.com. REALTORS that belong to the Honolulu Board of REALTORS have access to a more detailed version of the same database of real estate on Oahu. The Honolulu Board of REALTORS MLS also lists some real estate from islands other than Oahu, but the other islands belong to two other separate MLS databases.

Unlike New York and some other areas of the country, all REALTOR Members of the MLS have access to the same MLS data and it is in one centralized repository. The vast majority of all real estate on Oahu is sold through the Honolulu Board of Realtors Oahu MLS, but there are also a few FSBOs that are not listed among the Oahu real estate in MLS, and a few properties that are sold without listing. As a result, working with numerous agents does not give a Buyer an advantage or access to more Oahu properties, as it may in some other localities. All agents have the same ability to access to information about Oahu Real Estate. In this State, buyers typically give agents the courtesy of working with only one agent at time.

6. Oahu Real Estate is Broken Down Into 11 Primary Regions - These are Metro, Diamond Head and Hawaii Kai (all in Honolulu), Kailua and Kaneohe (which together, we call Windward Oahu, and this area includes several towns up and down the Eastern or Windward Coast of the island), Northshore, Central (Mililani and Wahiawa), Pearl City (Pearl City and Aiea), Leeward (Kapolei, Makakilo, Makaha), Ewa Plain (Ewa Beach) and Waianae.

In each region there are also many different neighborhoods. It helps to know these regions when you are looking for real estate on Oahu. It helps even more to know the neighbohoods on Oahu. Each region and neighborhood has its own different character, weather and other attributes. This is where a great REALTOR comes in. The Oahu MLS allows your REALTOR to search by neighborhood, region, city, tax map key (TMK) or zip code, or public school districts --- whatever works for you.

7. Looking at Property - In some areas of the Mainland, EVERYTHING is on lockbox. In case you are not familiar with this, a lockbox is a box on the door handle of or elsewhere near a home that usually contains a key to the door.

In Hawaii, some homes are on lockbox others are personally shown. Some homes are vacant, some are owner-occupied, but many, espacially condos, are tenant occupied. Tenant occupied homes typically require 48 hrs notice to show, as that is the minimum notice required under Hawaii Landlord-Tenant Law. So that involves a little planning. Unfortunately, agent cannot always show all properties on a moments notice and it is best to give at least a day or two notice.

8. Open Houses: Public Open Houses for Oahu Real Estate are typically on Sundays from 2-5pm and Broker's Open Houses are Wednesday and Thursday mornings (depending upon region). Public can attend broker's open houses, also, though that is not typical. The local Star-Advertiser newspaper has a list of open houses in the Saturday and Sunday paper. You can also find a list of Open Houses for the weekend on the Honolulu Board of Realtors Open House Page at www.hicentral.com.

Oahu Real Estate - The Basics of Purchasing Oahu Real Estate - Part One

Oahu Real Estate ... A book could be written on Oahu Real Estate and Buying a Home on Oahu. I will try to condense some important information about Buying Real Estate on Oahu into a nutshell. Hopefully, your questions about Oahu real estate will be answered here, but if you have more in-depth questions about any aspect of Oahu Real Estate, please don't hesitate to call me at 808-721-8088 or see my website at www.OahuRealEstateHawaii.com.

Not everyone is familiar with this island, so let's start with the basics:

1. Oahu is an Island - It's not a city and it's not a county. But the entire Island of Oahu makes up the County of Honolulu.

And Hawaii is the state (we are part of the United States, you'd be amazed but some people forget that) in which this island is located. Hawaii is also the name of one of the 8 major islands in the chain of Hawaiian islands which comprise the State of Hawaii. We call the Island of Hawaii "The Big Island," most of the time, not to confuse it with the State. But, sometimes, people get confused and call the Island of Oahu the Big Island, because it is the most populated of the Hawaiian islands and it is pretty big (#3, though, to Hawaii #1 and Maui #2). Try not to ever do this.

And remember when you fly here, to make sure to fly into the Honolulu International Airport (HNL) and not Kailua-Kona or Hilo on the Big Island. There is a "Kailua" on Oahu, too, just to confuse matters more. :)

2. Honolulu is the Largest City on Oahu ... And the most populated city in all of Hawaii. In fact, about 75% of the population of the entire Hawaiian Island chain lives on the island of Oahu, and about 75% of the population on Oahu lives in Honolulu.

What does this mean? It means, besides people, Oahu has more jobs, more housing, more activity, more cultural activities, more schools, more hospitals, etc. Oahu also has three major freeways, H1, H-2 and H-3 and other minor highways that help people to get around on Oahu. The City and County of Honolulu is also looking into a rail system, because the traffic on H-1 can get pretty bad at rush hour. Most jobs are in Honolulu or "Town" as we call it, but there are other pockets of commerical activity in all of the other cities and towns on Oahu, including Kapolei, Kailua, Mililani, Aiea, Kaneohe and other areas of Oahu. Many people also work from home.

3. Real Estate on Oahu is Expensive ... By most standards on the Mainland (Mainland = 48 states, Continental U.S., if you are unfamiliar with the term). If you are from big cities like San Francisco, Los Angeles, and New York City, you may not be phazed by the price of Oahu real estate. Oahu Real Estate Statistics.

But Property Taxes on Oahu real estate and all of Hawaii real estate are very LOW. More on Oahu Real Estate Taxes. That's a nice suprise, isn't it?

Certain other things on Oahu can also be expensive, like gas and electricity, but if you are from CA, again, you won't see much of a difference. More on Cost of Living on Oahu. If you move to Oahu, these items may not impact your family as much as you might think, as many homes on Oahu don't use or rarely use air conditioners and you almost never would see central heat in houses for sale on Oahu. Your commute also may not be as long here, as it would be if you are from somewhere like L.A., Phoenix or New York.

4. Oahu Real Estate is Resilient - The Oahu real estate market was not hit as hard as those on the mainland. Recent statistics show prices rising, though sales are down from the past months when the First Time Home Buyers Credit was still alive.

There are many reasons for this. Oahu has a large military population which helps strengthen and stabilize the real estate market, due to constant comings and goings, and which helps provide many civilian jobs to the local community. Just another reason for Hawaii residents to thank these fine men and women.

Oahu real estate also is desirable in a very global marketplace. Home Buyers and investors come here from all around the world. The Japanese, Chinese, Korean, and others have always been interested in Oahu Real Estate and they still are. Global interest in real estate also helps to minimize deep fluctuations based on the U.S. economy alone.

Also, local Hawaii banks have traditionally been very conservative in their lending practices. This is not to say that we are not seeing any short sales or foreclosures on Oahu, but it seems to me that most of the the affected lenders are mainland banks. Loans that were kept local have not been as problematic and, in general, those people are still in their houses.

Another factor that helps keep the Oahu real estate market strong is simply scarcity. There are limited bounds to this island. There is little new development in East Oahu. This island is a beautiful and desirable place to live. Basic concepts of supply and demand prevail.

5. You Can and Most Other People Do Own Oahu Real Estate In Fee Simple - Many people come onto this island thinking that fee simple Oahu real estate is not available, that the State owns all the Oahu real estate and you must buy leasehold, or that real estate on Oahu must be purchased via a lottery. This is not the case. To simplify the explanaton, it used to be that there were a few very large landowners and that Oahu real estate purchases were often only leasehold purchases. The landowners retained the fee simple interest and the leasehold owners rented the land underneath their home, which they owned. If the lease ended and was not renewed, you could theoritcally take your home away and move it. Does not work, though with a condo. Now, most of the fees have been sold and only a handful of leasehold properties remain. Many of the remaining leashold properties have the fee simple interest available to purchase with the fee. But others do not.

When considering the purchase of a leasehold property it is VERY important to have the good counsel of a knowlegable REALTOR or attorney. because, depending upon the circumstances of the particular property, it could be risky. People who buy into certain leashold properties could end up losing their homes and this is no joke. Not all leasehold properties should be avoided, however. Some can work for many people, depending upon your needs, and the terms of the lease agreement for the property.
