House HagAs far as I'm concerned, Bank of America can just kiss my ass!  Listen to this letter I got from them yesterday.

Dear (House Hag),

At Bank Of America, we are committed to providing you with clear, timely information you can use to make decisions about your credit card account (please bend over so we can shove another rate hike up your old kazoo)

Please read this information carefully. (you might also want to keep your heart medication nearby because we can feel a spontaneous aneurism or stroke gurgling up through the old pipes as we speak)

The following changes serve as Amendments to your Credit Card Agreement. (and in this case, please understand that the "Agreement" is unilateral and has nothing to do with what YOU want))  To help make them as clear as possible, we have included a summary ("What Is Happening") directly above each Amendment.  (Kind of like what your proctologist does while he's snapping on his rubber gloves and discussing the "procedures" he's about to perform)

  • Annual Percentage Rate:  We are raising Annual Percentage Rate(s) on your account.  (If you don't like it, tough shit) You have the right to reject this increase.  Instructions on how you can reject this increase and pay off your balance at the old rate are included in the enclosed Amendment. (Pay up or shut up.  We don't give a rat's ass how long you've been a customer of ours or how high your credit score is)
  • Transaction Fee:  We are adding or increasing certain transaction fees associated with your account.(Hold still now, honey...this'll only hurt for a minute.)
  • Foreign Transaction Fee:  The definition of what constitutes a "Foreign Transaction" is being expanded (to include every monetary transaction imaginable on planet earth)

We are also changing the following benefits and/or rewards associated with your account (please see the enclosed disclosures for complete details:

  • WorldPoints Rewards:  We are modifying one or more of the redemption options. (Your WorldPoint Rewards for spending $18,000 on your credit card will now be worth LESS than the prize your kids get in their cereal boxes, as opposed to THE SAME AS)

PS - And please be advised that Bank Of America is currently 6-8 weeks behind on responding to short sale requests from real estate agents like yourself. If you have not already done so, please re-fax the completed short sale package to 866-599-6666, even if you have already sent it 14 times to 8 or more fax numbers and/or mail drops.  We will contact you when we get good and god damned ready. DO NOT attempt to contact our loan mitigation department directly.  Don't call us, we'll call you.

I love how they are able to alter the terms of the cardholder agreement any time they want to.  I need to find whatever clause allows them to make changes in their favor anytime they want and start putting it into all of my contracts too.  I would love to be able to send a letter, "Dear homeowner, due to unforseen circumstances with my daughters dental work, in addition to my desire for a new BMW, your commission due and payable on the sale of your home will be adjusted to 9% of the selling price.  We apologise for this inconvenience but value you as a customer.  Thankyou once again for your continued support."

I was so incensed when Amex did that to me that I canceled the card. It was my favorite, but this action on their part to a cardholder that had never missed a payment was so disgusting that there was no other option. You described the reaction to this garbage perfectly- thank you!

Laraine - I have never been a fan of Bank Of America since my days in California.  As a young rockstar full of hope and flush with cash, I deposited my money into an account.  No offers of good accounts, just a plain Jane savings and checking.  The fees piled up quicker than receipts on tax day.  One day, September 11th to be exact (yes, that one), I had an appointment with a different bank (Union Bank of California) if you're interested.  I opened up several accounts (business and personal) all with extra features and services (I never once went to a teller to do transactions at that bank - I was treated very well) because of the amount of money we were talking about and walked across the street, withdrew every dime and never looked back.  I will never be a fan of Bank Of America.

Laraine, so, I am not feeling the love here, rofl. I have to agree, BOA sucks. I use a very small, independently owned local bank. And guess what, the don't have one, not one foreclosure on their books. And they don't sell their loans. But, banks being what they are they do have their quirks too.

The solution is, we need to be less dependent on credit cards for sure. I am NOT bending over for any bank though. I would rather go without.

Glad to see others are just as angry as I am Laraine.  I can't see how having the government take over some of these institutions can be any worse than what we are currently experiencing.  The large banks are just as or more bureaucratic than any government agency I have every experienced. Laraine, I'm waiting on my letter.  A friend received a letter yesterday and they raised his rates by 10% even though he was never late on a payment.  Well today he got another card from a credit union and transferred the balance.  They don't care though.  They know most people will not even read the letter.

How funny and how true! I've got a short sale listing and the client's loan is with Wells Fargo. Been on the market for 3 weeks with 1 showing. So I want to drop the price. Asked my client to talk to Wells about this.

They responded, "you may drop the price if you wish. We will not do anything to determine the value until we have a firm offer. If we determine the offer is less than the value, we will ask for a better offer or ASK FOR A CONCESSION ON THE COMMISSION!!!!"

Did I really just hear that right? Yes I did....and why I rarely show short sale listings to clients. I ask them up front when they sign my brokerage agreement, "Are you willing to pay the difference when the bank "screws me" for working so hard? Most say no. If they insist I work for whatever the bank is paying, I kindly escort them to the door!

This business is hard enough right now without working for a "guessing game" paycheck at the end! Sorry, I got bills to pay too!

i had a credit card company do that to me last year... never late, always paid more than the minimum due, and still they increased my rate from 7.9% to 30%.... how ridiculous is that!!!! i quit paying them at all out of rebellion... yes.. that will hurt my credit, but it is the principle of it... if they can screw me like that, then i will screw them by not paying another dime!!! this was a company called ADVANTA... stay away from them!!!!

Laraine, I just HAD to read your bio.  Your post was SO funny and I love the name of your blog.  Hilarious.  I was thrilled to see Ralph.  Have I got a woman for him!  She is one hot sassy number, spoiled ROTTEN and the name "bitch" came from her, trust me.  She is 7, thinks she is "all that and more", is good for nothing but snoring and snuggling.

Oh....... short sales and loan workouts with BOA are a sore subject with me.  I ended up contacting The Commissioner of Banks as well as The Attorney Generals Office in our state then, only then I received a workout person with a direct phone number.....this has been ongoing since 2/08.  I Feel your frustration ughhhh.

Loved your post! My sister in Florida got this same letter on Friday she called me she was so upset. We moved her acct to a small bank that was in her town that is locally owned. She had been with BOA for over 27 years same credit card no bad credit and she got the same letter. She was incensed and took her balance and transferred. I have always hated dealing with BOA on any real estate deals since they take the position of not talking to the Realtors only the clients...Need I say more.

I have not used a credit card in over a year now. I have one just in case of an emergency, but I don't use it. I got tired of all of the "Stuff" you are talking about. I would like to see every American payoff their cards ( this is probably never going to happen ) and not be dependent on anyone for credit ~ they would sing a different tune then.

As for the short sales, I think they want to get into the real estate business. You write an interesting post.

Laraine - ha ha, you really made me laugh. But it is so true. I had a letter like that but not even sure who it was from. The credit card companies are out to make it as misrable as they can for creditors, including cutting their limits, raising their interest rates, even if they are paying more than a minimum on time every month, and all the while continuing to implore people to take out yet another credit cared. Is there no one watching what is going on and the impact this is having on folks who are already having problems? Seems to me the credit card companies are doing just fine financially - is it any wonder?

These issues might have something to do with location.  Florida is a high foreclosure state whereas in Oklahoma, they are not a problem and I have yet to get a letter like that from any of my CC companies including BofA.  The only decrease of any kind was thru Dell Business Finance and originally I had a 10K limit and it was reduced to 6K.  Honestly, how could anyone spend that kind of money on PC's or printers?  They could chop it down to $1000.00 and it would not bother me one bit.

Now, here's the cold hard truth.  Credit cards are evil and should be paid off monthly and I have been there done that and now have -0- in credit card debt so it can be done.  While I don't really follow Dave Ramsey, I know what he preaches and it's all good things to know.  Susie Orman I just cannot stand but Dave seems to be a little more with it.

Truthfully, the day will come when they will need us and we won't need them so payback will be a BI***.

Laraine - Please don't forget the other wording ...

You may opt out of this rate increase, but if you choose to use your card AFTER opting out we will raise your interest rate to the default rate of XX.X%

We have a BOA card with a rate of 6.4%.  But if we USE that card it will default to 29.9%.  So ... now we have a $25,000 credit limit but can't/won't use the card.  We have NEVER been late, have paid the card off 3 times in the last 5 years, and always make more than the min payment when we carry a balance.  We have used the card as our funding source for rehabbing our rentals and making repairs. 

I absolutely detest BOA.  I would rather chew on barbed wire than talk to them.  And you can bet that as soon as I can get that card paid off ... it's going in the shredder.

Eventually BOA and all of the other banks will get just what they have always wanted, all balances paid off.

What are they going to do when everyone is so pissed that they close their accounts? They are just not thinking ahead. How do you wrong the people who are keeping you in business by keeping their credit good and using their products responsibly.

I have gave up on large banks about 6 months ago. Credit Unions all the way for me. I can't believe the difference in service I am recieving from them. They actually treat you like a person in the smaller institutions.

I say we all revolt! We can cripple them if we all just "Say No" to their products and their wicked ways.

You go get them girl. Bank of America is even hard to deal with clients who are struggling with their debt and trying to get out through debt management. Another major culprit is Citibank. They tried hiking up my interest rate and charged me twice as much claiming I missed a payment. I never did, and my payment went from 120 to 640 for one month. I told them to keep the card, I'm no longer interested and they said they will bring my rate back down to 12%. Oh btw they hiked it up to 24%... they reduced my payment to 410 because I was also apparantly over my limit...? Turns out it was a huge mistake but the rep told me to pay the 410 and I will be credited back... I'm still waiting for my credit...

Let it loose girl you need to. I hope you feel a whole lot better after getting that out. I had similar bad short sale experience with IndyMac Bank I sent it out about 20 times it seems like and they never got it and eventually foreclosed on the house.

Welcome to the Universal Default Clause... in almost every credit card jargon that is too small to read and in good times no one noticed.  It basically gives the bank or insititution to do what they want when they want until you owe them no money.  They can even raise the rate on their card if you have a problem with another card.  Good blog!!

Laraine- I love the letter interpretation! In times of recession the creditors get very tight with their credit and raise the interest rates. I just received notices of reduced credit limits. I guess that is because I don't use the credit cards except for online purchases, then pay my card right off from my bank account. The best thing to do is to tear up the credit cards. This is a blessing in disguise as credit is very tempting to use.

On the other hand, the part about their short sale procedures must be right out of the BofA own play book and their countrywide is even worse. Katerina

Last year Congress passed a legislation that will make this kind of stuff illegal for lenders to do - problem is they gave the banks 18 months to implement it.   I see this stuff every day in my line of work.  In any other industry this would be called entrapment - but because the banks own Congress lock stock and barrel, this kind of stuff is legal in the banking industry.  The worst part is that the customer service department is rude to you on top of it.

It's not just the credit card rates that they are raising!  I've had a checking account with B of A for 12 years, and they recently started charging me a monthly service fee.  When I stopped in to find out why, The answer was, It's always been that way.  Well, no it hasn't, because I have never paid a monthly service fee!?  Every other bank in my town offers free checking to me as a new customer, why can't my bank that I have been loyal to for 12 years?  Lets just say, I will be moving all my accounts to a different bank as soon as I have time...it is a real pain in the butt, but worth it.

I dumped BOfA a long time ago.  They ticked me off with one of my accounts that had about $200 in it.  The Manager was an idiot and really rude so I said "Fine.  Just cancel my accounts right now."  She responded with an ok, how do you want your $200? real snotty like.

I said "No. Cancel all of my accounts.  This one, my savings account and both credit cards. I don't want to do business with you."

Then walked next door to Chase and have been happy ever after.  :)  The look on her face was priceless.

I agree with the very first post.  A necessary evil and if you don't need it, then good for you!

My favorite move is (e.g.) $5,000 credit line - $1,500 balance = $3,500 credit available.. letter arrives stating your new credit line is for $1,500 and you are now maxed out... Oops!

I would think that a post that was written more professionally would be worthy of this honor......

A post laced with all the profanity this one has is does NOT merit a feature in my opinion.....

I heard some of the agents around our office talking about how BOA is looking at the regions and how many foreclosures are in that region then dropping the credit card limit of cardholders in that area because they are in a high risk zone.  Puleez.

I remember when my sister was trying to do a short sale with Option One...OMG! I swear she faxed those docs a hundred times if she faxed them once.  Ocwen is the same way.  Banks have NO business in real estate whatsoever. They are just a bunch of number crunchers and paper pushers. They don't know the laws nor do they care.

I couldn't disagree more with some of the folks commenting that this post was perhaps inappropriate.  What Laraine so honestly and candidly reveals to both Members and Public is the simple reality that Realtors, Brokers, and Agents are  flesh-and-blood people, too. 

We are not real estate robots spouting out market stats like HAL from 2001: A Space Odyssey.  We are people who feel the same frustration and anger during crappy economic times as the butcher, baker and candlestick maker.  We are not apart...like mythic gods on Mount Olympus.

One of the reasons I selected the doctor that I have been with for years is her humor.  She is skilled beyond belief and she is able to make me laugh when I need a medical procedure that scares the you-know-what out of me.  She's real and that realness makes for a fantastic physician.

Our clients need to know that we "feel their pain" in a very real sense.  If that requires that we crack the mask of uber-professionalism a tad...so be it.  As the great Mae West once said, "It ain't no sin if you crack a few laws now and then, just so long as you don't break any."  Laraine...thanks for the crack!

I shall now get off my soapbox and get back to completing that CMA.

I actually wrote a credit card company, who did this to me a year or so ago, the requisite letter saying I OPT OUT OF YOUR RATE INCREASE. FEEL FREE TO DROP ME ON YOUR SUGGESTED DATE. They did NOT drop me and did NOT increase my rate. Only problem is they just keep putting me on notice hoping I'll miss one. It was fun for awhile but now I'm bored. My solution is, as ever, just don't carry a balance! That'll show 'em!

It's not just Bank Of America that's doing this.

I stay with BOA because everytime I have attempted to switch I am treated worse. I had another card company, Advanta,raise the rate on a never overdue, never over limit business credit card to 36%. Needless to say that card went to the shredder.

BOA will still give me mortgages with little aggrevation which is more than my local bank or another national bank did.

They are still a bank, though....

Love the post. My business mastercard  raised my rate from 9ish to 36% because we missed a payment. We had the money---it was an oversight. I know, I know, our own fault but c'mon.  I tried to get them to change it and they wouldnt so I stopped paying. Thats a dangerous game for your credit score. They started calling and I told them to shove it. I would never pay it, its a non secured debt and they could send it to collection. I didnt care about my score. This went back and forth for about two months. They just called an gave me 4.9%! Im still shocked.

Everyone knows they are starting to hurt. You have financial talk show hosts telling people not to pay the cards.

Dont worry about BofA. Wells Fargo will probably end up owning them. It already owns the whole country mortgage-wise.

I can feel your frustation.   Personally I think the credit card companies are screwing themselves.  The credit card revolt is now in process as we write.  So many people have just stopped paying their bills.  Which is not right but I absolutely cannot blame them.  The credit industry has been one sided far too long.  I vowed to NEVER use a credit card again.  So far I have stuck to it.   I give the credit card industry about two years and they will be BEGGING for our business back. 

I often think back to when my husband and I first got married, we were lucky if we had two nickels to rub together.  But we were so happy.  We didn't have anything so we didn't have anything to worry about.  We worked so hard to achieve all the great "stuff" we have now only to find out we were so much more happy when we had nothing.  Go figure...

I could not agree more. It is more than a shame when these companies are allowed to get away with this type of greed and unethical type of behaviors. Companies like this that have also recieved money from our government to bail them out, yet they do not want to help the American public out when they need it. BOA is one of many doing this. Citi and Chase are doing the same and several months ago after that got their hands in and out of the money jar they started sending out letters to the same effect. We also discovered that most of their jobs are seated overseas in India and other countries. That is when we decided to pay off our cards and boycott anyone that was sending our American jobs and money out of the USA. Can you imagine the impact it would have on these companies if more Americans were to pull their funds and pay those cards off or change them to true American banks? We were just talking about this at work this week as well. Many businesses allow you 5 to 10 days before late charges are applied, but these card companies charge the fee the day after the due date if not paid. They will tack on the overage fee just to make you go over in some cases, we found this to be true with Chase, and then they increase the interest everytime they want to. The GOVERNMENT needs to put a cap in the interest these companies can charge and the fees they can charge, but of course we all know that there are some in Congress who will not go for that as they are in some way tied to the big Card Companies!!

Hi Laraine - Someone beat me to it, but my first thought when I saw your post title was "Gee, Laraine, how do you REALLY feel"? ;-> We have a high limit credit card with Countrywide that was just closed due to the merger. Have had it since our first mortgage with Countrywide back in the early 90's. Our "reward" for almost 2 decades of loyalty is B of A? I think not...

I'm going to confess here.  I flagged this post this morning.  I requested that whoever featured this post should be immediately removed from that postition. 

More people will now look at this as a model to emulate.  I hope not.  I ask myself, would I want my mom to read this?  Would I want my 12 year old daughter to read this?

I did go through some of your other posts.  They seemed very well written.  I read your profile and saw that you like rhubarb pie just as I do.  I guess your house hag character is your outlet to let off some steam.  You're probably not at all like the house hag but everytime I see your picture now I will get a vision of "fresh squeezed poop" and a nasty hag saying "kiss my ass".  Maybe I'm weird, but that just isn't that attractive to me. 

It seems like you got attention here but I still can't get that poopy ass vision out of my mind.  Just my two cents for what it's worth.

hahahaha, I love your post ! I got the same letter and I used some choice words, crumpled their letter, burnt it, called them the next day and told them to go.. "you know what "themselves because I was not going to pay them back a dime, abused them more when they started to give me a lecture on morality !!!!!!!!!!!!!!

What I so do not understand is.....why have you put a "*" where the "i" should be in your colorful word in your comment up above, Laraine??? You held nothing back in your post...why now in your comments?

Do ya think the public coming here and seeing your post AND your comments will not want to do business with a real estate agent with such language.... as evidenced in some of the anonamous comments already posted here....hmm?    ;-)

Seriously, there are better ways of saying what was said in your post.... different words could have been chosen that convey the same frustration and anger..........and I do not think I am being "uber-professional" in saying that....

Even TLW did not use profanity in her comment to you Laraine..... and she is VERY colorful  in her posts......

BTW...I did flag this post with my first comment....... and I e-mailed Bob Stewart also, so he would talk to the person who featured this post in the first place and kept it in "Public Mode" for the visiting public to see......

I hope you understand I am NOT being a prude about this...I am just guarding the AR memberships image to the reading public that we make our living from in helping them with real estate matters.

I hope you understand this is NOT personal in any way....  even though in your post you used the Lord Gods name in vain..... everyone is human...... we all make mistakes....

Greg....as far as I know, this is the FIRST time a blog containing profanity has been featured AND BEEN KEPT PUBLIC...

From what I understand, all previous posts containing profanity have been members only, weather featured or not, to protect the valuable public image we all have in the real estate profession.

Is it conservative (or wrong) to want to protect that image?

I agree with you being allowed to express your opinion to the AR staff and letting them know you are unhappy. AR guidelines do state however, not to ATTACK a fellow member on a blog, especially in their comment section.  Furthermore, I find it unfortunate that judgment is being passed and religion is being used as a supporting force. This is a public blog Alexander. If Laraine wants to make public ridicule about anything that you think "stinks," than perhaps it would be wise for you to steer clear of the conversation all together. To associate yourself with something that you perceive to be in poor taste means you want to be a part of it. Your outcry & constant zingers are also reflecting on you as well.

I'm no saint when it comes to following the letter of great blogging, but I don't waste my time attempting to follow he crowd with my posts. And I don't care I enjoy what I blog about.

I find it insulting when somebody makes a negative comment on my blog. If you don't like what I have to say, then kindly leave the room or say nothing at all. It's the most self respecting thing a person can do in my opinion. This is not small claims court, a reality tv show or anyone one person's home. We all live within the AR walls & must play nicely or risk being asked to go away.

Lastly, the blog was featured for a reason. Whatever reason it is - GOOD if you ask me. Going against the grain, and making new conversations teaches people different things, usually for the better.

You use religion as a backdrop for your blogs Alexander. How do you feel when people attack your freedom to express your feelings & opinions? Your views are not accepted and beloved by everyone here on AR & neither are mine. Most people are respectful enough not to launch an assault or public character assassination.

If God wanted us all to be exactly alike with no difference of opinion he would of done so. Lets just celebrate our differences? What do you say? Humble yourself & please let this blog be fun.

By the way.. Bank of American can kiss ALL of  my ass for what it's worth. A 35k toilet for the CEO? Now that stinks.

Your understanding is incorrect. Members have the ability to determine what goes in their own blog. Period, end of story. If it violates our community guidelines we will remove the post. This post does not violate our guidelines. If there is language you do not agree with, do not read the post. You saw the title and didn't like it and you continued to read. Laraine is an adult, she can make a determinations of what is appropriate for herself. I am not going to make those determinations for her and NEITHER ARE YOU. And ultimately a consumer will decide whether they want to work with her or not.

In a personal email to me (I only mention it because you have) you said that this erodes the professionalism of ActiveRain and if we don't do something about it you will walk away because you don't want to be associated with something that sheds this type of light on your profession. I can certainly respect that but I would encourage you to focus that desire for change on something that will have a positive impact on your industry and your clients, Mortgage Fraud, Homelessness, Divorcing the real estate commission, and numerous other things come to mind. Policing how your fellow professional conduct themselves via their written word is not your place, sorry.

I featured this post by the way because I recently got the same letter. Would I have used the language that Laraine used in a post that I made public? No, but Laraine has to live with the reprecussions of consumers out there knowing that she has a potty mouth, somehow I feel like she isn't going to lose sleep about it. You shouldn't either.

The contention that allowing foul language on ActiveRain is going to somehow taint the consumers view of real estate professionals in general, well I just don't agree. You have aired your objections and someone can read those and determine that you choose to take the moral high road just as easily as they can read Laraines post and she that she has colorful language.
