I wanted to give a shout out to our title companies and how (SOME) of them go the extra mile to get our business and some don't seem to care that much.  I made up my business plan for this year and made commitment to connect with more title companies, so when I need my farming materials I would have a better supply than I did last year. I have found you can't depend on just one to supply your needs, if you are doing allot of door knocking.  With the market the way it is now, door knocking is in - at least for me.

What I have found is that a title company sales representative will come to you and promise you the moon in order to get (ALL) of your transactions.  They will come and speak at your office meetings, bring lunch and even sit down and meet with you individually and try to help you get up to par so that you will bring in the money (opps I mean transactions).  But what they really want is the whole office's buisness, not just your 1 and 2s --- they want volumn.  So they are really trying to impress the broker and depend on him to talk to the office and try to swing them over that way. 

Once they feel that they have you hooked, have you notice that they just walk away and don't come back around you unless you are not calling them with escrows.  I have had one case were I asked for materials and they were so low that they could not give me any.  They know that the business is slow right now, but that does not mean that we agents don't have to continue to go out and door knock and try to drum up business and that we need the materials to do that (buyer's handbooks, seller handbooks, foreclosure material, short sell leaflets, maybe a few door hangers, etc.). 

So I have had to move my loyality to another title company that is happy to give me the materials I feel I need in order to better approach the public.  I figured out that it is real good at first with the sales rep so get as much as you can then and always keep another title company sales rep's number handy.  Because if you are not bringing in big hugh volumn you might be forgotten by the present title company rep.

Don't get me wrong, I love the title company's help.  I have just ran into a few bad ones that do not put that extra in their efforts unless you are among the tip top producers. 

Anyone else experiencing this problem?  Who are your best title companies to work with?

Can you say RESPA VIOLATION?

It is illegal for title companies to do what you are describing. The fines can be in the 7 figure range.

I don't think you understood me or I said it wrong.  I don't see that they are violating RESPA.  They just give us material to hand out like brochures on home buying, selling tips handouts, door hangers and access to the realnet - nothing more than that.  From what I know these are not violations.  They just get relaxed and put your request for more those handouts on the back burner is what I was saying.

I would not knocking them for not doing something they are not suppose to do anyway.

I know they don't have to do anything but they want our business that is why they have those handouts for you.  Its just that when you need some, everyone seems to be out of them.

Sorry if I wrote this wrong, I will not say that they are violating anything.

How is that when they all give them to you.  Are you saying we should not be using the door hangers from the title company?

Maybe I should delete this one because I do not want to give anyone the wrong idea of what I was talking about.

I thought it was ok for title company to give us items like note pads, door hangers, handout (informational) and nothing that can be taken as a bribe, but little stuff like was OK.

Please let me know if you know of some other rules on this.  I would appreciate it.

There is a dollar limit. If the notepads say XYZ Title Company, that's ok. If the notepads say Mary Jane Realtor, that is taking something of value that violates RESPA. Ask your title rep. They KNOW the answer to this.

Oh everything I get from them have their name all over it.  From door hangers to note pads (I don't get many note pads just for my office use anyway).  But door hangers, booklets that they print up with their name and information on them and the brochure stands is about I ever get from them.  When I order a property profile I get the folders and that is it.

When I make up my goody bad for my clients or my door knocking, I give them stuff with the title company's name on it and if I add something in that from me, it is purchased with my own money and of course it does have my name on it (it is named at all).

This is the what I was talking about, some run out of this kind of stuff or don't get back to you when you call and ask for it.  I know that ORTC in my area have offered the discounted prices and to justify that they cut back on other stuff. So they don't have any of the bells and no whisles at all.

Yet they seem to have one of the best warranty deals.

Given all the information you and I have exchanged does my article make more sense to you now?  There are no violations.

I work with MTC Title here in Columbus.  I get nothing other than great service, but that is what I want.  I need them to handle all of the closing details without asking me a ton of questions.  That way, I can go and book more deals and get them (and myself) more closings.

What I am finding is that they are slow now too, so they are working on their marketing plans and business plans and that does include the sales rep going out and drumming up escrows.  So they have other services that they offer (within the guidelines) to realtors to help the realtor drum up sales and also the loan officers bring in the refinances - etc.

They want us to remember them. 

I get good service (usually) and when I don't I sway to other Title companies and that is what my article is about. They start off good and bam -- they slow it down.  I called to get an pre-sale escrow open on a short sale, needed it yesterday and I got it next week, therefore my submition to the lender was delayed just long enough to p them off and I lost the short sale deal. 

Now do I know if they would have approved it had they had more time? Nope but I sure know that the ball dropped at title.
