This is an actual check from one of my First Time Buyers who bought a home last month, and immediately filed his 2008 tax return - which he had already filed an extension for - and this week received the above check !

 

... before his home purchase, his return was going to give him a refund of approximately $4,000 !!!! ... as you can see, he qualified for the tax credit, and received $8,000 additional dollars from the government for buying his home.

Per the IRS.gov website, you may qualify to receive this credit if you meet the following qualifications:

"... qualifying taxpayers who buy a home before Dec. 1, 2009, can claim the credit on either their 2008 or 2009 tax returns. They do not have to repay the credit, provided the home remains their main home for 36 months after the purchase date. They can claim 10 percent of the purchase price up to $8,000, or $4,000 for married individuals filing separately.

The amount of the credit begins to phase out for taxpayers whose adjusted gross income is more than $75,000, or $150,000 for joint filers.

For purposes of the credit, you are considered to be a first-time homebuyer if you, and your spouse if you are married, did not own any other main home during the three-year period ending on the date of purchase."

 The credit itself:

  • Applies to purchases that close after April 8, 2008, and before Dec. 1, 2009.
  • Applies only to homes used as a taxpayer's principal residence.
  • Reduces a taxpayer's tax bill or increases his or her refund, dollar for dollar.
  • Is fully refundable, meaning the credit will be paid out to eligible taxpayers, even if they owe no tax or the credit is more than the tax owed.

 

So if you were considering buying a home this year - be sure to talk to your accountant as you may also qualify to get $8,000 extra dollars for buying your first home !

 

ALSO: Be sure to check out a post  from respected Loan Officer Jeff Belonger explaining how you may be able to receive an 'up front loan' for this credit to use towards closing costs or additional downpayment over your mandatory 3.5% payment on your FHA loan !

Hi Debe ! They can even get it now if they filed already, by filing an 'amendment' to their 08 return ! My client just knew that we were in the process of buying before we actually closed, so he filed an extension, we closed and he filed the complete return at once - including a little application for an $8K credit !!!!! :o)

@ Donna H.  .... just word of caution.. I would be carefull telling people that the checks come back quickly. I know of 2 people that filed for the extension and it's been over 2 months and they still haven't received their tax credit checks.Just food for thought on how we explain this to buyers.

I'm impressed that he received it so quick from IRS?  Geez, aren't these the same guys that penalize you if you don't pay on time...but when you have a refund you could die an early age sitting by your mailbox waiting for the "check in the mail!"  HA!

Educating your customers is so important. Not too many people KNOW if they have NOT bought a house within the past 3 years, they qualify for the $8,000 credit too. 

I did some consulting and some web design with this Cincinnati Real Estate broker site. TREO Realtors. Take a look at the home page, and the $8,000 page we created for them. This is the kind of stuff all agents need to be educating your next time home buyers on.

In November 2008 we had 11 months of home inventory at or near the $500,000 price point. In May 2009, that inventory dropped to about 5.5 months. So technically speaking, we can all say the recession ended about seven or eight weeks ago. Even in slow markets like Santa Fe NM -- home sales are picking up.

It's great that you added the actual tax form.  Thank you.  However, if you have buyers who make over $75,000, it's possible that the MAXIMUM $8000 tax credit would be reduced.  And, it's very possible that you have first time buyers over that adjusted income. 

I recommend you advise your buyers to check with their accountant or to pre-fill out the above form themselves if their income is over $75,000/yr. rather than "guarantee" they will get the full $8000 credit.  Better to be safe than sorry.

The IRS is picky about dates - so caution your buyers to pay attention to the dates. They don't want to accidentally close 3 days too soon because they sold their last home 2 years and 362 days ago!

Also, remind them that they have to close on their new home before December 1 - maybe that will help some get off the fence and get moving.

I've heard rumors of a credit in the works for people who aren't first time buyers... will be watching the news for more.

Great post Sheldon, I just hope that what I am about to say isn't the norm... I am in an escrow with someone that could really use the credit, they filed an extension for 2008 just because they knew that they would owe and are trying to gather all their eggs along with buying a house (and initially knew nothing about the tax credit). Last week their mortgage broker called to say the bank want's their 2008 taxes filed first, now they are scrambling for a new bank, we will have to wait and see how this play's out. Congrats to you and your buyers though!

Rock on !!!  This is awesome.  We all talk about the tax credit but there is nothing better than visuals of "hard core disco" from Uncle Sam.  Is a great incentive.  I still wish this incentive was for ALL buyers but that is another story.  It still is all good.  This is the BEST time ever for a first time homebuyer to purchase.  Great post !  ~ Chris

You are a hoot, Sheldon! Thanks for the info, and if I have anyone looking in Bergen County, I'll definitely send them your way. My dad lived in Allendale and then Ridgewood for almost 20 years, so I have fond memories of the 4th of July fireworks in Mahwah. Hope things are good up there.  The market is still down in Savannah, but signs of life are springing up. This tax credit should help a lot!

Why? Coz homes are still selling....though 1st time home buyers get some non-refundable tax credits (in terms of land transfer tax rebate).

You guys are lucky. I envy this tax credit back cheques.

For those that say 'show me the money' you've done that! I think like you have added, buyers better check with their accountants on all this so they don't commit any fraud! Don't skirt the rules, do it right and get what your entitled too!  Great informative post when this whole issue is so confusing!

This opportunity is available not only to first time buyers but persons that have not owned a home in the past three years. 

Wish there were a way to let those people become aware - many are still confused about this credit.

Hi Sheldon. Super nice job on this post. Like everyone else before me said 'that picture of the check says it all!'  There has been so much talk about this program, but to actually see a check makes it real for more people.  BTW, my accountant said that the fastest way to get the check is if the buyer had filed an extension. An amemdment is expected to take more time.

It is $8000 for properties purchased in 2009 with escrow closing on or before Dec 1,2009.-With no repayment

It is $7500 for properties purchased from April 2008 to Dec 31 2008.

With $500 pe/r yr repayment for 15 yrs starting on your 2010 Tax return

Just to clarify, the difference between the 2 very different tax credits.

This is the 3rd home sale that I am closing in the last 2 months and my clients are getting back $8000 to use for repairs, upgrades, etc!  They are so excited and I am excited for them.
