The Ultimate Irony in Short Sales

I have ranted and gripped about short sales before, and I have sworn that the one I am doing now will be the last one I ever will let a buyer get into. It now looks like the one I am involved with now will be over sooner than I thought though.

My buyer put an offer in on a short sale over a month ago which the listing agent represented as having already been blessed by a negotiator and ready to close in 2 weeks - start to finish.  HA!  The sellers were about to lose their home because the wife had lost her job with the downturn in the economy and the husband, who works for a floor company, was making considerably less income because fewer people are renovating their homes and putting in new flooring.   We submitted the offer to the listing agent who had the sellers sign our offer, subject to third party approval, and then the listing agent sent our offer on to the bank.

Naturally, because this is a short sale, our offer is now languishing somewhere with a bank in a stack of other short sale offers, and we have no idea when it will ever come to the light of day.

Now -this is the irony.  These sellers have been waiting so long for the bank to act on our offer (and the one before ours) that they may be working their way out of their financial difficulty. They have now told the listing agent that they are interested in trying to work something out with the bank to stay in their house.  I don't know if they will be able to achieve that. I hope they can for their sake. What it means for my buyer and me is that we are back in my car looking for another house - and not a short sale this time. Lucky that I like her!

Lise, I just closed one that took over 6 months start to finish.  Thankfully I had a really patient buyer and they landed a fantastic deal.  It can be a really long process but if you're looking to get a really great deal the wait can reap huge rewards.

Wow, that's quite a story!

Not knowing the market you are in, I do hope your Buyers will have a decent selection of houses to choose from in their price range. No doubt you will make it happen for them!

Like you, I tend to feel less than comfortable working with Buyers on short sale properties, but I always stress to them the importance of their patience in the process (as you, no doubt, did!).

It's surely not often that the seller ends up being able to turn their lives around and find themselves able to save their home. While it's good for them, you & your Buyers have been pushed to the max.

Good thing your Buyers have an agent like you -I hope they appreciate you!

Brian - my point was that it seems like the seller is trying to get out of the deal - not that my buyer isn't willing to wait. Somehow this is a huge mess, as Chris said, and the sellers may actually be protected here from being forced to go through with this contract. Who knows! That is a question for my title attorney tomorrow. Just a headache tonight.

Oh - and yes, I am truly delighted if the sellers are able to pull themselves out of this situation. THere are lots of other houses for my buyers - but isn't it ironic if that is how this all ends up!

Lisa - I am into double digit weeks on a short sale, unfortunatley, it isn't helping the seller. It is certainly a frustrating process, but most for the listing agent who has spent well over 100 hours in trying to drive the paperwork through.

Lisa, that is a sad AND happy story. I am glad for the family that may be able to stay, but sorry for your client. Good luck finding homes that aren't shortsales...you definitely have to be in the right price range in our area!

Lise - aren't these interesting times?  Each short sale transaction is an adventure unto itself.  Good the sellers may be able to keep the home.  Your buyer will probably find a better buy - it is the way of the universe for good people.
