Inspired by a thoughtful post by Jacob Clayton, it's time for an attitude change about copyright infringement.

Folks who have had their copyright protected content (any original writing, image, photo, video, etc.) copied and published by another person, usually have pretty typical reactions:

Shock!

Sick to the stomach!

Disbelief!

Anger!

WE ARE NOT FLATTERED!  Are these the emotions of a person who has just been flattered?  If you find that any property has been stolen, do you feel flattered???  I don't.  Telling me that I should feel flattered when my property has been stolen is to demean the value of my published content.  Our content has valua.  It is, after all, our advertisements to the public that bring us contacts leading to commissions. 

OUR CONTENT HAS REAL VALUE.  Perhaps many believe that our content has lettle value because we do it ourselves.  If we pay a web site design company $10,000 to create a web site for us, we know that web site content has value.  However, there appears to be a belief that, since we have designed, written, provided content to the web site ourselves, that it has less value.  Not so.  Copyright infringement damages can be very costly to the offender.  I have successfully collected anywhere from $750 to $41,000 from persons who used my copyright protected web site content on their web pages.  I also have a judgment for $60,000 from another.  At this time, I am in court with another and am ready to file on another.  Over the past 3 years, I've collected over $200,000 in copyright infringement damages.  That is real money.  If I had felt flattered, I would not have pursued these cases.  I was shocked, sick to the stomach, in disbelief and angry, so I protect my copyrights vigorously, as provided by the law, see: 

(c) Statutory Damages. -

(1) Except as provided by clause (2) of this subsection, the copyright owner may elect, at any time before final judgment is rendered, to recover, instead of actual damages and profits, an award of statutory damages for all infringements involved in the action, with respect to any one work, for which any one infringer is liable individually, or for which any two or more infringers are liable jointly and severally, in a sum of not less than $750 or more than $30,000 as the court considers just. For the purposes of this subsection, all the parts of a compilation or derivative work constitute one work.  More. . . .

COPYRIGHT INFRINGEMENT IS ILLEGAL.  Over the years since first advertising my real estate services on the Internet, I've discovered my original and copyright protected content on the web sites of others no less than 20 times.  I can tell you, when I see my property on another agent or broker's web site I DO NOT FEEL FLATTERED.  I pursue each and every case discovered.  My first reaction is "shock".  Then the emotions slowly turn to a feeling of "sick to the stomach".   Eventually, the shock and sick to the stomach feelings turn into "anger".   Throughout the discovery, the "disbelief"that a competitor or other entity would steal the content of another for personal or commercial gain in violation of the law. 

IF YOU ARE CAUGHT WITH MY INTELLECTUAL PROPERTY ON YOUR WEB SITE, IGNORING ME WILL COST YOU!   One thing is constant.  When receiving a Cease and Desist and Demand for Damages letter from my attorney, the reaction is almost routine.  First the offender removes my copyright protected content from their web site.  Then they ignore us.  BIG MISTAKE.  The longer they think that I'll just go away, the more it will cost them.  The attorney's letter didn't say, "Remove Lenn's content from your web site and we'll go away."  It's already too late for that.  The damage is done.  You have already benefitted from the illegal use of my intellectual property and you will pay for that use.  My attorney is very good and very expensive.  The longer the offender delays settlement, the higher the legal fees to me and the higher the demand to the offender.  As the case proceeds, the more obsticles placed in the way of settlement, the higher the demand. If the case gets to a judge, damages are very, very high. 

OUR EMOTIONS ARE NATURAL.  When discovering my property on another person's web site, my reaction of shock, sick to the stomach, disbelief and anger will not be dismissed by telling me that I should be flattered.  When discovering that the article we agonized to write, or the image we worked hard to create, or the photo that we took the time to take and publish has been used by another who expended little energy, no creativity and no actual work beyond a simple "cut and paste", our emotions are not a feeling of having been flattered.  It is a primal feeling of. . . . . . .

Shock!

Sick to the stomach!

Disbelief!

Anger!

Thanks for the very informative post Lenn. I admire you for going after these people as many agents would just let it go. By the way, how can you find out if someone is stealing your material? Part of me wants to think that no one would steal our content but I suppose it can happen to any of us.

Lenn, This is one of those issues that I'll never fully understand. Otherwise, caring and honest people, who would never think to steal anything, seemingly have no problems lifting the intellectual property from the internet. There is a major disconnect somewhere. Brian.  As an attorney, you know that copyright infringement is a violation of the LAW.

IMO, I believe that the violators knows it and just doesn't care.  Otherwise, they'd just contact you and ask. 

Fact is, IMO, they just don't think they'll get caught.

Cindy.  It's a different take, but I'm not flattered when someone takes my images.  About 2 weeks ago, I found a competotor's page with not only my map, but several pages of content including, are you ready for this. . . .  

A photo of my home on their page.  You gotta love the irony.  I'm sure they didn't know that the photo was my home when they stole it.  Not only that, they used a photo of my former home in Bethesda as an example of fixer uppers. 

When I sent it to my attorney, the comment was, "I'm surprised they didn't have your photo on their page." 

That was funny.

Lenn, I completely understand the feeling of violation, along with the anger, disgust and disbelief.   Additionally I see copyright theft as cheating, and in my other life as an artist, I have had this discussion sooo many times with artists who just don't get why copying something is just wrong.  It is wrong.  Whatever form intellectual property theft takes- music, art, writing - offenders need to be brought up to speed in the manner that you pursue, because in my experience a little chat usually doesn't work.  And it is not flattering to be on the receiving end of the theft.   It is a violation.

I really enjoy your posts on this issue, and thank you for taking the time to share with us.  Bravo.

Lenn - I'm honored that you took the time to read my story and sincerely appreciate your willingness to share your experiences and vast knowledge on the subject. The responses I received yesterday from the folks in question 100% confirmed my musings on their character (actually, they are far less intelligent than I could have ever imagined but what can you do). They are positive that they did nothing wrong and that I have no idea what I'm talking about which to me says they have done it before and would certainly do it again. But I'll do everything I can to stop them!

Lenn = I agree, - folks just don't see anything wrong with it, think they can use whatever they want on the Internet, and don't think they will get caught. I had a guy take one of my short sale artciles, in its entirety including the images AND the discussion, in midstream, about California disclosures (he was in Florida). Not the sharpest knife in the drawer.

Decided I was feeling too good this morning after reading your post, Lenn, so did some checking on Copyscape for an article of mine that has been plagiarized at least 4 times in the past - yep, Shock! Sick to the stomach! Disbelief! Anger!

Found another abuser right here on AR! Actually I'm not shocked, unfortunately. Sent off a nice email - we'll see what happens.  I hate this - who has time to deal with this!?

Patricia.  To date,  I believe that, even if they don't admit it, they know it's wrong.  No one lives in that thick of a bubble.  Copyright notices are all over the Internet,  Even on Google Images where many of my maps are indexed, copyright warnings are right there.  I believe that folks choose to ignore them thinking they won't get caught.

Lenn, I second that wholeheartedly. Autism and PDD-NOS are my soft spots. I talk and joke openly about it but am very protective of my babies. The boys are my personal poster children because I'm their Mama. I speak at a lot of functions regarding this subject and how it affects us because a lot of parents did this before me and helped me and mine cope when things looked hopeless. I don't like when my kids are somewhere they are not supposed to be, used without my permission on someone else's website. Taking my photos off of ActiveRain, Facebook or Flickr is a big no-no.

I don't know how anyone could feel like the HOURS we put into our work could have less value than paying someone else to do it for us. If anything, I feel it has more value if I'm the one who did the work. I know what had to be done, and how to do it better than someone who does not have first-hand knowledge of my subject matter.

George.  You are absolutely correct.  I made a decision 4-5 years ago to go after EVERY SINGLE person who violates my copyright, every single one. 

The experience has been enlightening in many ways.  One thing that gives me the determination to prosecute each and every one is the fact that, the law is clear and on my side.  The copyright thieves cannot win.

How much they eventually pay is determined by how long they delay, obfuscate, deny, lie and otherwise drive up the legal fees in their case.  If they settle quickly, they will soon be gone.  If they don't it will cost them dearly.

Damages paid to me is completely under their control.  The only certainty is that they will pay.

Terry.  I have not found the people who take my intellectual property to be apologetic.  Quite the opposite.  They are angry that they got caught or believe that the law doesn't apply to them or have some thought of entitlement to what ever they want.

Ove the years, only one of the map thieves actually apologized.  I reduced my demand from $5,000 to $2,000.  He paid it immediately.

Very well said.  I have had Realtors copy my buyer and seller testimonials and even the names on their own websites.  Do their brokers know they may responsible too?  It seems no on wants to get the word out.  Theft is theft.

Lenn, No matter how many times you post about it there are still cut and pasters on activerain. On our company website you can't right click or copy. Sometimes I try to copy my own listing descriptions to paste on another site and it doesn't work. There is technology to prevent copying but I'm sure the infringers will figure out another way.

Bill.  Indeed, they are shocked, not because they find that they did something wrong, but because they got caught and now will pay for the risk they took when they used my content.

Mitchell.  Sure you can, but my content is often used by students and teachers and I'm not going to restrict access to images, etc.  If a home buyers wants to copy my map and put it in a folder with listings, how are they going to feel when they hit a brick wall and cannot print the map??? 

My content is already protected by the copyright laws.

When I first joined Activerain, I read one of your comments somewhere talking about this.  I had never thought about this, but ignorance will not help you in court.  Now with this post, you have definitely scared the bejesees out of me.  I carry my camera at all times, and spend hours writing my posts.  Maybe the first time,I would feel flatered any body using my content, but I do spend hours coming up with what will I write next.  When I write about events, now I call to see if I can use their pictures and information.  Every one has been happy I write about their business.  Thanks for keeping us informed.

Sharon.  Indeed.  The perp lifted an entire page from one of my sites which included information about several counties in the area, a county map, photos of homes, one of which is mine and one of which is my former home used as an example of remodeling homes.  He had everything but my photo and copyright notice.

My how some things never change.  We designed a beautiful website for a client, who has moved on to use a platform that has integrated IDX.  This is understandable.  What is not understable, is that the web hosting company and the client have put the site back up without credit to our work!

Our custom designs can take more than 100 hours to design and code.  This is not some simple template that you cut and paste. 

The web hosting company is see no evil, hear no evil.  The client is ignoring communication.

I would appreciate any feedback.

Cherie.  I can't give you legal advice. 

However, if the client paid for the design, it could be a "work for hire" and they would own the copyright.

If you sold them hourly services and they agreed that you kept the copyright, that would be different.
