At Closing- It's All About the Money

When I was at the bank yesterday, I overheard one half of a conversation.   The Bank representative was trying to calm down an irate customer whose deposit had been put on hold.

Of course, I don't know what kind of check he had deposited, and I'm not a banker, but I empathized with the customer - I don't get it either!

When I purchase anything, by the time I drive home and get on the computer - that money is out of my account.

Yet when we make a deposit, our banks tell us there will be a ten day hold on the funds.

 

MONEY OUT = Immediate but, MONEY IN= Delayed???

 

This practice can really cause havoc when you need that money for a Real Estate Transaction. 

Last summer, my buyers had deposited Out of State Cashier's checks into their local bank 12 and 9 days prior to the closing.

They believed Cashier's checks were like cash. They had their money in Minnesota, now their money was in Colorado.... But no!  Their bank told them it could take up to 3 weeks for their funds to clear!

Unfortunately, they needed their money sooner to be able to close their lot purchase!

The money they needed to close was technically "nowhere". It wasn't in Minnesota anymore, but it wasn't "in" the bank in Colorado either.

This caused an unexpected delay in the closing. 

Some people also believe that money in their C. Schwab accounts, and the like, are immediate funds, but when those checks are deposited, they have to clear as well.

Make sure your funds will be immediately available to close, and if there will be a delay, plan your closing date accordingly.

Mary, what I don't understand is that it takes up to 10 working days for a credit card payment to post to your account but if your payment is 5 minutes late the late fee has already hit your account.

Hi Dan, Interesting how that works isn't it? I used to have card company like that, but I changed accounts.  In fact, I think that particular Company has a class action suit against them.  We also used to do business with a bank that at the end of the business day, first deducted all the checks, sometimes creating an overdraft - then added in our deposits that were there that same day -- that was in the "olden days" - but we quit doing business with them too!

Hi Ann, I'm finally happy with my card company and bank too -- people still run into problems with their funds to close, or holds on their checks though! 

(Sellers are often surprised that the cashiers check representing their net proceeds doesn't immediately clear, either. )

Now, I really quiz the buyers right away, as to where the cash is, so we don't have anymore delays.

Banks are being extra careful these days, because there are a lot of counterfeit bank drafts and even certified checks 'bouncing' around.  They have to allow enough time for the check to go back to its original bank, to be verified, and yes, this can take weeks.

We have had funds wired directly to the lawyer's trust account; or if a client is transferring funds from one far away bank to another bank in the City, they can wire those funds as well, from one bank to the other, rather than take a check to deposit.

It's very frustrating, but I guess it's for the good of everyone, with all the fraud these days.

Mary,  The buyer's agent from a closing on Thursday has phoned me NUMEROUS times to complain that HIS 'funding' was not ready yesterday (Friday)!  It seems that EVERYONE is worried about the money these days!!

As for the banks account of funding--in NC, there is no longer a delay (same day) UNLESS the funds are over $10K.  Evidently this is a federal issue--however, if the funds are wired from account to account, this can be avoided.  I think that could be the new 'green' topic--no more Certified Checks--only paperless WIRES!

I just did a closing where we found out a day before closing that the rules had changed, cashier's checks were not allowed, the money had to be wired.

Makes sense to me....it's immediately available....wonder why this wasn't the policy sooner?

Hi Sylvie, I agree with you that wiring funds is the best course.  I know that there have been fraudulent "cashiers" checks, too -- still difficult for the ordinary consumer to understand it.  Also, many banks will not initiate a wire unless the customer goes into the bank!  Sometimes, I guess that creates a roadblock?  I appreciate your input on this, Sylvie!

Hi Debe, I think a wire transfer could be the new "green" topic!  Buyers who wire their money should have no problems.  Colorado is a table funding state, I think most sellers like to leave the table with the check in hand -- but again, he/she won't be able to take that money to the next closing, or spend it immediately, if there is a hold on his/her funds.- some hesitate when they are charged the wire fee too!

Sorry to hear about the buyer's "funding issue" on your sale -- it does seem that short of electronic transfer, many are running into delays/problems!  Hope it gets all worked out!  Thank you for your thoughts on this, Debe!

 

Hi Coleen, Yikes! at least you found out the day before! I hope your buyer did not already purchase his cashiers check, and then had to pay the wire fee also!! That would be upsetting!  I agree it makes sense, especially if the closing company is wiring the payoff -- wire in - wire out. Thanks for your comments tonight, I appreciate it!

Mary, we are at the mercy of the banks........their rules not ours. Wiring is the only sure way to know that the funds will be available in a timely manner!!!

If a bank is on the watch list then some title companies will not accept a cashiers check drawn on that bank.

I cannot figure out why it still takes 3 weeks for funds to clear.  I would probably look into switching banks if that's what I was told.  Sad your buyers had to delay but glad you got it done eventually.

Hi Stacey-Ann -- in this electronic age, I don't understand a three week delay, and honestly, I still don't understand the 10 day hold! But, like Caren said, we are at the mercy of the Banks. 

I think it's important that buyers and sellers know the rules  eventhough we don't understand it :-)   Thanks for your take on this today!

Hey Mary, It seems crazy doesn't it?  Just went through a similar situation with an England buyer. He wired his funds from England to the US 3 weeks ahead of time for his closing this week. He called and called and called the bank.  The teller at the bank gave him the wrong bank routing # twice! The funds FINALLY got to his American account later than they told him it would, but in enough time to meet the closing. Thank goodness he started early. Otherwise we would still be waiting.

Hi Sandy, The wrong routing #, Twice!!!??? I was trying to be positive...but I would positively be going nuts if my money was "out there" in space so to speak, with the wrong account # or routing # on it!!

This is a good lesson to give a little room for error, and start early.  I know on particularly busy days, ie: the last day of the month -- the Fed is buried in wires, and sometimes wires are delayed due to sheer volume.  Thanks for your input, I'm glad your buyer got his funds in time for closing!

Hi Ann - I don't know -- with all the computers in the world it seems there would be a quicker way to do things doesn't it? I'm sure some of it has to do with the way banks "Float" ---but it hurts the people who don't understand it or who are not aware. IMHO Thanks for your take on it, I appreciate it.

Mary, Have you ever tried to get a refund on a credit card purchase? It can take 30 days. It's just not fair.

You bring up a good point about funds for close. I'll be on the lookout for trouble now.

Hi Rich, Is New Mexico an escrow state?  I'm not sure if would work any different, but since we are a table funding state, we run into this a lot.  Thank you for stopping by this old post, I appreciate that.  and no, I can't even imagine trying to get a refund on a credit card purchase, but in all fairness the consumer should be able to collect interest on their funds if delayed.
