Give me Liberty or give me real estate.

Huh?  Read on...

Liberty as defined by Webster's dictionary is defined in total as:

1. freedom from slavery, captivity, etc., 2. a particular right, freedom, etc. an impertinent action or attitude. 4. permission given to a sailor to go ashore. (not relevant).

Real Estate as defined by Webstar's dictionary is defined as:

real estate land, including the buildings or improvements on it.

Is there a difference? 

Is owning a home a liberty?  Is is a freedom to do so? Is it a G*d given right?  After all the settler's came to the US and worked the land.  Was it difficult then? How would we know. 

The situation that is at hand is that many home owners have abandoned their properties...only in some cases to have "squatters" living in their homes, 

What's a "squatter"?  A squatter, by definition according to Webster's and in reference to this blog is defined as:  to settle on land without right or title, to settle on land in order to get title to it.

That being said, many condo's that have been abandoned at over 30% have squatters.  They have broken windows or doors in order to get in.  They are living in a situation where there is no electric and no water in homes that have been abandon by the owners.

Doesn't seem to be a law against this and there (as is being told by me) is nothing that the condo association can do about it.  The police have been notified...

What do you think could be done to rectify this horrid situation?

Does this happen in your area of expertise?  (This is not mine, this is just a situation based on a phone call from a prospective customer).

What would you do? What would you say?

Thanks, that seems to be a new entity in some of the condo's in west Florida.  We have condo associations calling us and asking us what to do.  Hey, if the police cannot help you, what can I do?

As I am told, the police don't do anything. So, the property manager's are frustrated, out west FL.

Hi Karen.  Are you sure there is no law against breaking and entering?  As an owner, I'd call the police.  However if the owner just doesn't care anymore, then that is a tough situation and may have no recourse.

It sounds like it's time for association managers to make a visit to the local prosecutors office and insist that the police charge these people with breaking and entering.  Until they take the extra step it will continue.

Richard,

The condo association manager has called the police.  This particular condo is over 50% vacant and there are so many in there that they say they cannot do much about it.  Most of the condo's that have the squatters were abandoned by their owners.  It's a situation occuring in west Florida.

I don't understand either.  I guess if the owner's have abandoned the property and cannot be found, there is really no one to press charges.  The manager of the property said she is trying to keep the property safe...to no avail.

Karen, The owner is the bank who forecloses on the borrower who defaulted on the bank.  Since the bank is now the owner they need to be held responsible for taking care of of and securing the property.  In California legislation is being written to hold Bank's accountable for their "Bank Owned", property.  Here they must take care of the outside as to not affect the rest of the neighborhood with dead lawns etc.  Hey, thanks again for contacting me and helping me out!!!
