I passed by a beautiful home on the water of Lake Livingston yesterday. It is a home whose homeowners have been discussing "selling" for a couple of years.

It may take you longer...

Are you ready to spend money to advertise?..............................................

Do you know where to advertise?..............................................................

Do you know what the most effective way to reach your buyers is?.................

You must be prepared to answer the phone many times a day......................

You must be prepared to answer (honestly) all questions about the property..

You may have to endure "lookie lous" and "lowballers" but I think you can....

You will be interrupted in the middle of your holiday plans to show it.............

You must ask if they are pre~qualified if you don't want to waste your time...

You may have to follow their moves and watch the children.........................

You will probably be awaiting a visit that never comes................................

You must provide a Seller's Disclosure by the law.......................................

You will need to file an executed contract with a local Title Company............

Remember to tell them about the septic system.......................................

Were you built before 1978? Don't forget the Lead Based Paint Addendum...

Are you aware of the option period and how that works legally?...................

Will you visit with their Lender to verify the contract and lending?................

Don't forget to review the local laws of your Associations............................

Remember to provide the form for the transfer of the Association..............

You're going to sell some of your personal items? ..................................

Do you know how this is handled when a lender is involved?.....................

Will you remember to get that in writing?...............................................

Do you have a copy of your old survey? ................................................

Do you know if it is still valid?..............................................................

Are you aware of what constitutes a valid survey?...................................

Do you know what one costs?..............................................................

Do you know who provides the survey?.................................................

Do you know how to dispute a disagreement or encroachment?...............

Will you recommend an inspection?.....................................................

Do you know why you should?.............................................................

Are you aware of what happens if there are needed repairs?...................

Are you prepared to take a legal stance should there be a disagreement?

Will you offer them a Title Search and Insurance?.................................

Do you know why this is important?.....................................................

Will you offer them a Home Warranty?................................................

Do you know what a warranty covers?..................................................

And why a warranty is important?.......................................................

GEESH...I COULD SO GO ON............................................................

So, Mr. and Mrs. FSBO, this is just the tip of the iceberg in selling a home the legal and ethical way.

Are you really expecting this to go your way?

If it does then "congratulations" to you.

I got overwhelmed reading your list.  There is so much that FSBO's are not aware of.  When you get a clean and organized list, please email it to me.  It would make a good mailer for FSBOs.

Oh I just let them go right ahead and go for it on their own.   Then I bring the buyer and negotiate and work the deal for my clients.

But, Deb, you can save soooo much money doing a FSBO -- don't you know that! Yeah Right! :-)

I've had calls from buyers who think they'll save money by talking directly with the listing agent, or going with a FSBO. They don't want to pay those agent fees for a buyers rep! Huh! -- clearly, they don't understand the set-up. I do try to explain as best I can, with this feeble, home-inpsector mind. :-)

How about ... Are you really comfortable letting strangers into your home?  Are you aware of the scams that target for sale by owners, such as people posing as buyers, but actually targeting your home for theft (fishing for information, asking you what time you will be home tomorrow, etc.)?

Yeah Deb...this should be easy no sweat, if you guys can do it a home owner with one transaction twenty five years ago should be able to do it with no problems..law suits, defaults, co-mingling of funds, disclosure issues...no problems at all..piece of cake.

I have NEVER gone after FSBOs although I frequently show them if I know of one that might work for a buyer of mine.  Yesterday I just listed my first FSBO, after showing it and talking to the seller over a period of several months, but never actively pursuing it.  Interesting.  He was actually doing a pretty good job I thought, all things considered.  But essentially, AFTER 4 MONTHS OF "FUN" he said UNCLE!  He is more than ready and grateful to hand it over to me and not have to worry about all the things on that long list of yours!
