There is a posting on REALESTATERAMA describing the advertising promoting the REALTOR® and the home inspection company contributing to the sponsorship.
Is this a bold move to promte business for both or a blunder begging for a complaint?
MA requires home inspector licensing as of 2001. One of the motives for licensing was to eliminate unethical alliances between home inspectors and real estate brokers and salespersons. The law for sellers is MGL Chapter 112 Section 87 YY 1/2. The home inspector regulations are listed in 266 CMR 8.03.
I can make arguments for either side of this issue.
The issues I wonder about are:
Does this home inspector have any liability/responsibility for the actions of the home inspection company?
Does the real estate sales person have any liability/responsibility for the actions of the broker?
