I keep getting inquiries from Russian brokers whose clients from Russia are interested to purchase properties in the USA, mostly in Florida and California so far.

Everybody wants to sell of course, but a problem arises when Russian brokers ask to share a commission with them, usually 50/50.

As I'm helping with communication, I know that this issue is important and often prevents the future cooperation at this point as many US agents say that they can't share their commission with an unlicensed person. Period. Some say on the other hand that they can pay if this person is licensed in another US state, some say - licensed in another country. But Russia has no licensing system by law....

So, where's the solution?

I took the labor to read through Florida Statutes Chapter 475 Part 1 Real Estate Brokers, Sales Associates and Schools. It says in # 475.25(1)(h):

"... however, a licensed broker of this state may pay a referral fee or share a
real estate brokerage commission with a broker licensed or *registered under
the laws of a foreign state
* so long as the foreign broker does not violate
any law of this state."

*registered under the laws of a foreign state* implies that it can be any type of business registration in any foreign country?

Im surprised someone says they cant pay another real estate agent a commission but I will say no one will split it 50/50 maybe 25%, that's pretty costumary

How do you ensure that they are following all of the laws when they are not familiar with your state let alone the laws that we have learned over the years that come and go and get tweeked here and there. Is it a law suite waiting to happen?Dinah Lee

to Dinah: Russian brokers can never violate any Florida laws (or any other US state laws for that matter) and the reason is simple - just because they never lived here and now they are not here ;-)  so, no violation on their side is possible, it's very easy to comply with, it actually comes automatically as they are not here...

to Heather: thank you, this is one more opinion to add to the collection of opinions on the subject ;-) but at least you are sure that it's possible, just the amount is negotiable...

I tend to agree with Heather. I have no problem paying a referral fee (legally it would not be a commission), but 50/50 is a little extreme when you consider that some hve to also pay their own brokers out of what they make. And that's not counting your essential services. Other than that, I would love to welcome Russian buyers to the New Orleans market!
