You may want to Visit Realtor.org for further info on this... it is a bit of old news from earlier this year but I still hear agents being asked to negotiate their commissions on a short sale.  I have always advised listing a property at full commission for your area.  In NJ "full" is typically 6%... and Fannie seems to feel that that is a fair number.  It doesn't do you any good to list a potential short sale at a discounted rate!  You will work harder and longer and you do deserved to be paid more than minimum wage! We are professionals in this business after all, NOT CLERKS, NOT ORDER TAKERS!  When choosing a doctor you don't shop based on price do you?  (I HOPE YOU DON'T)

Fannie Mae Confirms Short Sales Commissions Policy

In discussions between the NATIONAL ASSOCIATION OF REALTORS® (NAR) and Fannie Mae, Fannie Mae has reconfirmed its short sale commission policy and established a process for REALTORS®to follow if issues arise. On February 24, 2009, Fannie Mae sent Announcement 09-03 to its servicers instructing them not to negotiate commissions on short sales below the amount negotiated by the listing agent, unless the commission exceeds 6 percent. The Announcement reminded servicers that third party approvals (i.e., private mortgage insurers) may be required and can affect commissions. In response to concerns raised by NAR that some servicers of Fannie Mae loans are unaware of this policy or believe it is not binding, Fannie Mae has established a process for NAR members when short sale commission issues arise.

 

So, next time some one asks you to cut your commission, mention Fannie Mae announcement 09-03. Just because it is out there, doesn't mean that lenders are conforming to it. Knowledge is power and we all deserve a pay check at the end of the day!

Short Sale Commission-Ectomy Help!

Surely if you have been involved in a short sale transaction the home owner's lender has attempted - and usually succeeded - in slashing your commission.  Now, help is available to resolve the vexing issue of commission extortion. 

Thanks to the efforts of the National Association of REALTORS (NAR) in response to the growing dissatisfaction of the membership over the outrageous practice of contractual interference perpetrated by some loan servicers.  I say contractual because the lender is apparently interfering with a valid listing agreement between consenting parties. 

It seems that some servicers of Fannie Mae loans are unaware of FNMA's short sale commissions' policy or believe it is not binding on them or simply choose to ignore the published policy. 

Fannie Mae has established the following process for REALTORS to seek assistance when short sale commission issues arise. 

Step 1: Determine whether the loan is owned or guaranteed by Fannie Mae. Only the holder of the loan is allowed to do this, so do so in the presence of your client or after obtaining their written permission.  Log on to FNMA's website: www.fanniemae.com/loanlookup  or call: 1-800-7FANNIE. 

Step 2: If the servicer is unaware of or disagrees with the policy, provide a copy of Announcement 09-03 (available on www.realtor.org ) to the loan servicer and negotiate an appropriate commission based on the listing agreement (up to 6 percent). 

Step 3: Contact Fannie Mae if the dispute is not resolved directly with the servicer. Be prepared to provide the property address, name of owner, and Fannie Mae loan number (if available).

And, thanks to Fannie Mae for doing the right thing.

This is so important....we work so hard for short sales and then they want to cut our pay....really annoying. The problem is that in holding to our guns, we can put our clients in jeopardy by holding things up or risking the lack of approval. We need an after-the-fact procedure to get the money we deserve.

Karen, even last year I saw selling agents stick to their guns... all they need to do is say: "I  will bring my client to another listing down the road, there are 100's to choose from in this price range"

Risk, perhaps... but now with the fannie letter to fall back on, not so much.

I think the key is that the agent has to price it right--- enough to get the bank their 'net'...and to cover your commission, etc.....

I've listed short sales for 7%, just so I'd be sure to get my 6%.  They're a lot of work on both sides and if the listing agent isn't demanding at least 6%, he or she is doing a disservice to the seller.

Hi Amanda, glad to see you!  Shorts are not that hard if there is work done up front and everyone cooperates. Mostly the Seller! and if everyone understands it is going to be a longer closing with a few bumps along the way, Its not a bad thing!
