San Diego California Real Estate- Update on HVCC crisis affecting San Diego Homeowners

In my recent post discussing some of the difficult problems with the HVCC rules implemented in May 2009, I received this bulletin forwarded from a  local mortgage broker here in San Diego. In involves a new bill before the House of Representatives to suspend for 18 months the new HVCC guidelines that affecting the quality of appraisals here in San Diego and across the nation. Here is the bulletin I received last night.

NAMB APPLAUDS BILL TO SUSPEND HVCC
IN NEWS - RESIDENTIAL MORTGAGE

The Home Valuation Code of Conduct (HVCC) may be suspended for 18 months, if one recently introduced piece of legislation has the legs to move through Congress. H.R.3044, introduced by Rep. Travis Childers, D-Miss., on June 25 and co-sponsored by Rep. Gary Miller, R-Calif., looks to impose a year-and-a-half moratorium on the heavily debated appraisal code.

Last week, National Association of Realtors Chief Economist Lawrence Yun suggested that “faulty valuations” slowed home sales transactions in May - the month the HVCC became effective.

H.R.3044 has found the support of at least one trade group, the National Association of Mortgage Brokers (NAMB). The organization’s president, Marc Savitt, released a statement urging Congress to swiftly pass the bill.

“In the period of time since its implementation, the HVCC has increased costs to consumers and decreased the quality of appraisals, and has provided a level of uncertainty in an ailing housing market,” Savitt said in the statement. “Tens of thousands of consumers have already been robbed of their opportunity to enjoy historically low rates by Attorney General Andrew Cuomo’s rule.”

William,

How can we fight some thing that sounds so good to the naively uninformed? Protecting consumers from collusion and criminal conspiracy sounds to good to be true.

The fact that there was no mass problem, and where there was we already had sufficient law all we needed to do was enforce it should have eliminated any problem. Oh, to announce we are now going to enforce the law would mean Congress would have to tastily admit they are part of the problem.

Thanks for the heads up! An 18 month hiatus isn't much, but it's a start.

Hi Bill,

There is a lot to the story that of course the press has not written about. Of course we can gather why that might be. As you say, it's a start but unlike the bulletin I posted I don't have that much faith that it will actually happen, though I remain hopeful. But then I am also hope that we will have rain and in the middle of the drought, beating drums and dancing around may sound like useful activity but there is no empirical evidence that it brought brought rain. Blisters however remain a good possibility.

Hi William - HVCC is another example of something that had good intentions but went far astray.  Our office is hearing from a lot of appraisers who have decided not to continue in their profession, and have come up with other ways they can work in real estate - as transaction coordinators or assistants to Realtors, or ?? 

One gal was close to tears when she told me of all the years she had invested in becoming great at her profession, but as a single mom with three small kids, she cannot afford to give the appraisal management company 40% of her fees, and she can't double her fees and expect to get any business. 

So we will likely have longer waits for appraisals, among all the other more obvious problems.  I'd love for them to suspend it while they do a major rewrite, or do away with it altogether and come up with a better idea.

Hi Susan, it might not have been as unintended as we think. Certainly, I hope Congress will agree this has been a seriuos error and suspend or repeal. Hope springs eternal but I wouldn't" count on clear thinking because important people in high places may have a stake in keeping it like it is. William

Thanks for the follow up on this. I knew something was in the works with NAR but not sure if it was moving foward, so I appreciate your post.

I'm in agreement with Susan that it was well intended yet (IMHO) causes more problems than solutions.

Hi Lynda, Happy 4th! Heading down to SeapPort Village to see fireworks and see if I learned anything about taking night pictures. They insist that I need a tripod and I haven't purchased one as yet ( and I am not sure I want to lug it around just yet , especially with a bazillion people that are expected tonight.I have a a little one but not sure that would work.

The unintended consequences are interesting in light of the new problems that appeared rather quickly. Too bad insight follows decision making instead of the other way around.
