There has never been, in recent history, a better time for first-time homebuyers to negotiate a sale on any property...bank-owned, owner-owned or short sale.  However, there are hazards in the making. 

If you think that bypassing a Buyer's Representative and dealing directly with the listing agent gives you an advantage, you are sorely mistaken.  It is your choice, however you will be handing over all of your confidential information to the person listing the property.  Now, in the State of Minnesota, that constitutes dual agency which means that the agent holds no preference to either party.  They cannot, or should not, disclose price, terms or motivation to either party.  Do you really want to give up the representation of what could be a bulldog on your behalf to a chihuahua?  (Sorry to you dog owners for the analogy.)

You likely won't save money.  However, you are giving the agent a double dose of what is best for the agent.  A high price with little negotiation means a higher percentage of the sale in the pocket for you-know-who.  So, when you are buying, be sure who is representing you.  You know best.  However, we don't define ourselves as wolves and lambs for nothing.  You must be sure you know what you are doing if you go it alone...Just stay safe out there.  Especially, these days.  Trust me, bank-owned properties and short sales are no easy walk in the park.  It was certainly bad enough with one seller-one buyer transactions, but these have cost me sleep and sensibility more than once. 

Be safe and hire your own representation.  It usually costs you nothing and you will be a lot safer, saner and glad you did in the end.

Good information. Home buyers that do not opt for an exclusive buyer agent may not get the expected bargain.

We discourage duel agency transactions for an individual agent on our team,  and refer buyers interested in our listings to another agent working under our broker.

It is bad for the buyer, and a liability to a professional agent to take on the daunting position of representing two parties!

Also, it costs you nothing out of pocket to have your very own qualified representation.

Suzanne-well said!  Too many buyers look to go around agents thinking it is benefiting them in the long run.  As you said it is not saving them any money and is definitely not in their best interest.  Nice to "see" you back!

Suzanne, real estate agents are the only professionals I know who would even think about representing both sides in a transaction.  I personally don't do it and think it can get very risky in terms of liability.

Although it is still duel agency, with over two hundred qualified agents in our market center, I consider it an "arm's length" duel agency, and do not hesitate to recommend a trusted agent to a prospective buyer!

Exactly! There was a post recently where the buyer pumped the agent for info and then said he would go to the listing agent to 'save money'. Silly wabbit!

I have lost two sales this year, because the clients bought the home the listing agent owned.  Thinking they would save the buyers side commission.  Sometimes that cost dearly.   You can't help everyone, some think they have all the answers already.  :)   NEXT!

Roy, that is exactly what I have said time and again.  But, there are a lot of "smart buyers" out there who seem to think this is similar to a vehicle purchase.....NOT!!!!

Patricia, I couldn't agree more.  How can you be the only mediator for two sides?  It never makes me terribly comfortable.  I almost always identify with my clients and understand their needs.  So I really hate to represent both sides because I want to be the strongest advocate for MY client.  

Candice - I will have to see if I can find that.  It would be great anecdotal info for clients. 

Gail - I certainly understand. And, if they passed you up...their loss.  It hasn't happened to me....yet.  But, it has nearly several times.  I can usuallly make clients understand that this is not like going to another car salesman.  However, losing your representation is a serious mistake!!!

Hi suzanne, I have had a buyer mysteriously disappear only to find out later that she had bought the home through the listing agent.  aaargh.

I do not like an intermediary situation without designated associates because of the fairness. I like to have each principle represented by their own agent so that all parties are properly informed and represented. This makes the situation less questionable and more desirable!

Angela, everyone needs representation.  Would you use the attorney representing the other side in a lawsuit?  I think not.
