EBA Portland, LLCEvery now and then I get an agent who wants me to change something on a contract that is:  NOT in the best interest of my client.

I can respect their try.  But, what I can't respect is the agent having the contract for days on end and then, seemingly at the last minute, reveal their "protective" nature.

We're  in a profession that requires us to read and review documents.  These documents serve both as an agreement, but also as a form to follow. 

If in a contract, and there are highlighted sections -- for example, Inspections, Terms, instructions to escrow -- PLEASE read these things!  But, not only that, know what each section of the contract means, what it implies, what the time-lines are, etc.

Many agents are unaware of their own sales contract.  They haven't read them, and don't understand the language. 

Having, for years, only filled in the blanks, they can convolute a very easy deal by not following the language of the contract. 

Don't allow another agent to convolute your contract.

READ the contract.

UNDERSTAND the contract.

You can't control your transaction if you allow the very heart of it -- THE CONTRACT -- to be misunderstood.

Amen and amen, Carla.  I spent all of today in an Ethics review at our local board and part of it was going over our contract forms.  It was an excellent class that I wish I had had earlier.

The reason for the pre-printed forms and standard counter terms is because most agents couldn't undertand contracts even if they did read them, which they don't.

WHOA. 

I thought the reason was because the language -- and let me emphasis this:  the LEGAL LANGUAGE -- contained in forms is best standardized.

But you are admitting that most Realtor(r) are dumb ass folk?  So they have to play connect the dots when filling in a contract on behalf of their clients?

Ignorance of ANY law is no excuse.

If an agent doesn't understand the basic, standard contract form they should not be an agent.  No excuses.  No hand-holding.

Good post Carla. I run into too many situations where I get an addendum at the last minute that throws a huge monkey wrench in the loan process. No phone calls before hand and little time to "save-the-day". If it doesn't work out I'm to blame...

THis would also be very good advice for a Seller and Buyer. DOn't just trust your Realtor, or for that matter, your lender. Read the contract, know what it is that you are getting into.

Very good advice, Carla.  Unfortunately, like some others, I think that many agents neither read nor fully understand the contracts their clients are signing.  Kind of scary for the client, I think.

Thank you for this post. I work in an area where three states meet and each area has it's own addenda. It's amazing how few agents really read their full offers.
