Whether you are buying or selling real estate, information is gathered by the respective real estate brokerage for business purposes. As such there are laws that govern the use of this information. The law is there to protect you and your information from being used for matters other than what it was collected for.
The Personal Information Protection and Electronic Documents Act (PIPEDA) is a federal statue that covers privacy issues involving business matters. The main focus of PIPEDA is that personal information cannot be collected, used, or disclosed without the consent of the person/people who are providing the information.
In the real estate business much personal information is collected in order to list or sell a home. Therefore a licensed real estate professional must ensure that the collected information is not used for anything other than what it was initially intended for. As an example, a sales representative does not have the right to contact you once your house listing has expired because the information that was collected on the Listing Agreement was to be used for the marketing of your home only. In order for a sales representative to contact you after your listing has expired, you must have given prior permission to do so.
The best advice is know your rights.
