In 2004 Senator Kennedy petitioned the Massachusetts State Assembly in the Commonwealth of Massachusetts to change state law.  This was when Mitt Romney (Republican) was Governor over a Democratic state legislature.  At that time, Kennedy begged the Massachusetts law be changed then to require a special state election to fill the vacancy of a US senator should it occur rather than let the Governor (Republican) to appoint an replacement.  The reason?  This was in case US Senator John Kerry were to be elected President...his vacancy would create an imbalance of power in the US Senate for the Democrats.  The change was made and so it became law that if a vacancy were to occur in the Commonwealth of Massachusetts the electorate would have a say in who was to fill that vacant seat rather than an appointee of the Governor filling out the remainder of their term

So before the Senator Kennedy passed away, he tried to get the now Democratic Gov. of the Commonwealth of Massachusetts and state senate to change the law that Kennedy so vigoriously lobbied to have enacted in 2004.  So prior to Kennedy's passing the Seantor's last wish was to have the former gubernatorial powers reinstated so the Governor could name an interim Democratic appointee to fill his soon vacant seat.  

My thoughts is that America should not be run like the royalty in Europe.  Our country was not set up to have political dynasties like the House of Lords trying to out flank and out think the rights of average citizens in an office that is for 6 years.  Special elections to fill a vacancy is actually a very good idea.  Bring the vote to the people and let them choose.  The Senator should have resigned in his months before death and let the process of a special election begin.  Now under Massachusetts state law they will only have one US Senator representing them until the issue is resolved.  Personally I think the Late Senator Kennedy had it right in 2004 when he lobbied so hard to change the law.

Neal Bloom-Realtor ® Assoc.-CRS-Weston FL (Keller Williams Properties) It is a sad commentary Neal that even near death the party came first, not the people he served.  If you read the article - Ted Kennedy was re-elected in 2006 and due to illness he has not been in Washington in the Senate where he belongs.  He rarely was there for any votes.  So in effect, the Commonwealth of Massachusetts has only had one US Senator acting on its behalf.  Would the rights of the citizens of that state been better served if they had an active advocate working for them for three years?  Now this process of a special election from what I am reading will not happen for another 5-6 months.  If Ted Kennedy was such an advocate of health-care would not the  issue been served much better by an active participant?  Or better yet by someone in his seat that could actually vote on the issue in DC?  Talk about a death grip!  This was it, but it was on the power of office that the late Senator could not take with him.  Best of luck with that power in his next life.

Jim..I do agree with you about the senators seat..it should not be passed down like royalty it should be voted on ..Funny thing I was around many people today..no one spoke of Ted Kennedy's death except on the media..food for thought

Hannah Williams (Re/Max affiliates NE)  I don't think he was as highly thought of as the media would leave us to believe.  He was a one party man.  In the DC area when I lived there he was mocked and laughed at for his behavior and shenanigans around town.  Out side of the district you never heard any talk of that.  Personally I don't think he compared to his brothers and their accomplishments.

In fact, I wish the electorate would have more of an impact on legislation too.

Hello Jim, I agree with much of what you've said here.  The US Senate and its members are very powerful in this country's political equation.  Our country must have quality leaders in those positions, and not just big egos and those dreaming of royalty.  I like the idea of the replacement Senator making their pitch to the constituents that will elect them, instead of having the incumbent governor of the State make the appointment.  John

Alexander-Slocum REMAX Team - Vancouver WA Real Estate (RE/MAX equity group, inc. - Vancouver Washington)  I think the late Senator had it right the first time.  That was the argument he used.  The people would have the say in the final vote. 

There is one thing that begs to raise the question...if the state is Democratic, and the Governor is Democratic was there a fear that the people would vote Republican?  If so, it would show the Senator now did not trust persons in his state to keep the seat Democratic.

John Mulkey, Housing Guru (TheHousingGuru.com)  So many of these politicians use the word bi-partisan freely but they would rather die then work with someone in the other party.  Talk is cheap and they will be judge instead by their actions which speak louder than their words.  They are hypocrites.

Sorry to be so mean spirited but reading the major news media comments sections it appears there are 9 negative comments to every one positive comment about Ted Kennedy and thus you are correct, most didn't like the man, but spent their time doing other things than worrying about him since being married their daughters were safe?

Wasting more taxpayer dollars trying to change the laws to game the system... what a fitting final  tribute to an unfit "leader".  If he really cared about healthcare reform he would have started by losing weight, getting off the bottle and promoting a healthy lifestyle after all, doctors need a little help from their patients! If he really cared about the "blue collar" democrat common man, why weren't spots at his funeral reserved for them???? Just dignitaries??? Sorry, I will stop.

Like MJ, the Media used him when alive for ratings as the joke of the town and in death because the public doesn't like character assassination of the dead they chose to make him into a Martyr.

No disrespect but on two occasions while working for the George Wallace campaign I got to meet the Senator, he was the partier we thought he was, he was probably the smartest person in any conversation, he was well liked by most but they wouldn't let him near their daughters. Again it is not disrespectful for the small minded out there. There are many republicans and democrats that are like that. But lets not sugar coat the way he was just because he has passed. I always thought he was genuine in his beliefs, very likable and a tomcat.

Charles Stallions Real Estate 800-309-3414 Pensacola, Fl.   You raise an interesting point.  It is so funny that when a real hell raiser passes away...you never hear persons speak more highly of them as if they were to be revered as a saint or something.  In life they were anything but theyre were not saints.  When I lived in DC - Ted Kennedy's had a reputation for partying too hardy even in public settings.
