What is a short Sale?

A short sale is a real estate transaction that occurs when homeowner cannot longer make their house payments and want to sell their home at the current market value (to avoid foreclosure), which could result in most cases in a short pay off to the lenders, because the loan balance is higher than the current resale value.  

 If lenders are willing to accept less than the full mortgage payoff, the homeowner could then list the property with a real estate agent (agent should have experience with short sale).  They short sale the property and allow the borrower's debt to be forgiven in most cases.

Keep in mind, that realistically, for a lender to actually approve a short pay, in most circumstances, at a minimum, the borrower/owner needs to 1) be in default of the mortgage and in receipt of a Notice of Default, and 2) be able to document some situation of hardship.  At least this is the case in Washington State, California and Hawaii, where I am real estate licensed.  I am also a Certified Distressed Property Expert (CDPE).

Jsut finished a search for a new buyer wanting a short sale. These do make me sad having been on the listing side as well.

Hello Douglas and Janice,

Douglas, in some part of the county some lenders will entertain a short sale as long as you have a hardship, and for others the borrower have to  be behind on your payment and have a notice of default. I personally have done the short sale where the homeowner are in default and have a hardship. Thanks for your comments

I have closed 3 short sale so far this year.  I have 4 short sale listings currently active and 3 more short sale listings coming soon, I just want to let you know, that you are not the only one working hard. Thank you for your comments.

Good point, they should be called long sales.  Mayra, are banks in your area pretty easy to work with?

Banks are the same here or there, all depend on who do you talk to. I have done short sale with some difficult people at SLS , but I finally found someone who was willing to help me and we close the deal. Thank you
