Update on Arizona Anti-Deficiency Laws

By
Real Estate Broker/Owner with Benjamin Realty LLC

Late Friday afternoon this just came into our e-mail box –

“Governor Jan Brewer signed HB 2008, which repeals SB 1271 and its change to the anti-deficiency statute. Arizona Association of Realtors (AAR) would like to thank our members for their quick response and action on this matter. AAR’s success is due, in part, to members like you who help engage on issues down at the Capitol. AAR will continue to work with legislators and industry stakeholders to protect homeowner rights at the Capitol.”

You can catch updated info about this topic important to Arizona homeowners on our Benjamin.com Blog.

Bob & Carolin,

Godd for you for keeping track, not only of the proposed changes in the laws, but also how (and who helped them) get there.

I didn't realize until recently that states can regulate deficiency judgments. To me that comes under the realm of the banking industry, and I thought banking was under federal regulations, not state. I think such statutes are a lawsuit waiting to happen if the right attorney loses his job and home and has a deficiency judgment filed against him. I can seem that attorney going to his previous law firm and working out a sweet deal for a lawsuit against such legislation.
