Top "Short Sale Lender Goofs" of the Week

As a Destin Florida short sale listing specialist, I've seen almost every crazy thing that can happen waiting for an approval.  This week was no exception.  Here are the top short sale lender goofs of the week:

1.  Bank of America: File Erroneously Declined in India.  Destin short sale appraisal in March was $950,000.  “Drive By BPO” done in August was 1.5 million, $100,000 higher! File was then declined as “insufficient” offer.  After I pointed out the minor discrepancy (our market is still declining, not going up 10%), the negotiator is re-opening.  She said the decision to close the file was probably done in “India” without looking at all the facts, to “keep down underpriced offers”.

2.  Suntrust:  Counters Wrong Offer.  I received a counter offer $180,000 from Suntrust on a Destin condo.  The buyer stayed firm at his original $170,000. The negotiator said the buyer’s offer of $140,000 was too low.  HUHH???  Suntrust imaging department had sent her the wrong file in my seller’s name.  If she had known, she said she would not have countered. Buyer almost walked.

3.  Regency Credit:  Lets File Lapse and Go Back to Chase.  Seems like I was dealing with Cousin Vinnie at this collection agency for a Santa Rosa Beach short sale.   They’re offered $5000 as a junior lien, reject it, and ask for more documents from seller.  All this while they knew they were losing the file back to Chase the next day, and they have nothing to show for it.

4.  ASC Rejects HUD After Closing- Threatens to Rescind Approval.  ASC’s approval letter states a required minimum net and closing cost limit, but nothing more specific. On this Navarre Florida short sale, the day after closing, ASC said that although they exceeded their net, they would refuse the closing because the appraisal credit was over $400, and that is all they would allow, among other HUD issues Attorney for seller told them they would lose in court, but changed around the HUD to appease them.

    Wendy - Does this support or go against your "love of short sales"?  It is crazy what can happen on the lender side during these negotiations.

    Wendy My latest was not nearly so interesting, Just:Lost the entire File and asked to start over again, At BOA...Yupp... No-Kidding but I have fax-reports telling me this file was send twice already...go figure

    We had one a few weeks ago where the lender had stalled the foreclosure sale indefinately and 2 seperate days we got calls from an investor that the property was being auctioned that day on the courthouse steps.  Investors on courthouse steps were excited as opening bid was $100,000 less than list price, so they bid on it at the sale.  Lender rescinded though and short sale closed!

    I love #4 and how they will kill it over something so miniscule.  I have a BOA that has been listed for almost a year and a half and they lost their last buyer.  A $4000 difference (this is a high priced property) and declining market they have lost $60K cuz no one would pony up the $4K (I tried for contributions, sellers - buyers - banks).  It's all fun and games when a $4K loss turns into a $60K loss.

    Wendy, I give you credit for sticking with it. I only had one short sale "try' recently. Listed at $329K, Offer $300K, BPO came in at $349K. Bank rejected offer. I raised the price to $345K per Chase Bank saying they wont go any lower even though I sent them accurate comps.3 months only 1 showing at the $345K price. I did have a great negotiator at Chase, who told me after 90 days the bPO would expire. I lowered it again to $329,000 and still no activity. Just your typical short sale story.

    BOA says offer is too low...buyer raises it...BOA does BPO and says offer is too high...ammend and close...duh !

    Ugggghhhh! 

    Thankfully I have no horror stories this week!  Just sunshine and rainbows.  Chase approved one in 30 days!  We just closed.  Greenriver Capital approved one within hours of offer submission and we just closed.  WOW!  There is light at the end of the tunnel!  I'm sending my good luck and warm wishes for easy short sales your way!

    Regarding #1 - India closed my file TWICE after being approved and awaiting assignment to a closer. The AZ negotiator got upset that India kept closing the file after she approved the short sale.

    PHH - Short sale was approved over a month ago but negotiator never contacted me. Wrote a blog about them and how stupid it is to go through a call center in India.

    I loved this blog and all the comments.  My partner and I have been experiencing the same bloopers.  We have made some good contacts and some bad contacts.  Sometimes the negotiators do not see the forest for the trees.  We have to educate them on business in done in our neck of the woods.

    A lender goof?  How about when a bank refused a short sale, and they foreclose on the property. . find out later that they sold it for $45,000 less than my short sale offer. . I don't look back  normally and usually  forget about these things . .but in this case it was the buyer that called me questioning why? why? why?

    All I can say. . 

    A certain percent of the population are considered to be morons. . this particularl bank just  happens to hire most of them for their short sale negs
