All you consultants out there... be aware of the law, I recommend that YOU start passing out the lead paint brochure and getting a signed acknowledgement for your file and then include a copy in your consultant report whenever you are working on a project built prior to 1978. Mike we have been using the lead paint disclosure for some time now here in SC. It required on home pre 1978.

Mike, same here. The Lead Based Paint disclosure has been in effect for quite some time.

Thanks for the comments. Yes, I am aware of the disclosure form you have been handing out but in a meeting the other day at the builder's association apparently there is a lot more coming down around us with regards to lead paint issues next year... I'm just telling our consultants that they may want to look into it more thoughroughly as I plan to. I'll see what I can find and post it.

This is interesting.  Massachusetts has been very strict about lead paint and lead paint disclosures for as long as I have been doing this (17 years).  Are they just starting in North Carolina?

Claudette, you are absolutely correct as we have in all of the other states as it is a federal disclosure reqiurement... however there is someting that is coming up next year that is even more invasive and will affect you and all of us on older homes sold after it becomes law. Thanks for your input.

I'm sorry everyone... for the confusion. I was at builder's association meeting and heard that there is a NEW law going into effect next year... we are all aware of the existing disclosures required for lead paint... I'm attempting to find out about the NEW law that requireds abatement... not just disclosure, if anyone has heard about it I'd really like to know more. What I have heard so far is that removal in certain areas of a home will be manditory and I'm trying to find out about that if anyone knows more we would all like to hear it, I'm sure.
