Home Buyers: Are you a CUSTOMER or a CLIENT ?This is a great question that you really should know when buying a home. If you have not signed a Buyers Representation Agreement, you are simply a CUSTOMER. If you sign the Buyers Representation Agreement, then You are a CLIENT and your REALTOR can provide CLIENTlevel services. Yes, there is a difference between the two.

What is the difference between a Customer and a Client ?

As a Client, your REALTOR owes certain duties that are not required of a customer. To be considered a Client, this must be done in writing. This is done when you complete the Buyers Representation Agreement prior to writing an offer to purchase on any property.

Agent for the Buyer.  (Client)

 The licensee's company is working as an agent for the prospective buyer, owes primary loyalty to the buyer, and will work as an advocate for the best interests of the buyer. An agency relationship of this type cannot, by law, be established without a written buyer agency agreement.

 We also use Designated Agency in Tennessee

Designated Agent for the Buyer  (Client)

 The individual licensee that has been assigned by his/her Managing Broker and is working as an agent for the buyer in this consumer's prospective transaction, to the exclusion of all other licensees in his/her company. Even if someone else in the licensee's company represents a seller in whose property the buyer is interested, the Designated Agent for the Buyer will continue to work as an advocate for the best interests of the buyer. An agency relationship of this type cannot, by law, be established without a written agency agreement.

This designation was started because there were / are licensees who are more focused on one commission than they are in building a business. Maybe a customer should find an experienced professional that has a track record of helping people close deals. Pushing the buyer representation can sometimes create as much mis-trust as it is supposed to minimize.
