WHAT! No 3% Co-Op

 A few months ago I get a call from an agent wanting to know if I would like a referral with a 25% referral fee. I say sure and she proceeds to tell me that it would be a listing and sends me over the paperwork.  Now, I take the listing agreement for 5% with a 2.5% co-op.  I listed the beautiful house in a great neighborhood for around $400,000. The seller bought the home about a year and a half ago and could only afford to pay 5% commission.

  Everything is going well and I'm getting great feedback. Then I get a call from an agent that said it fits the customer's needs and they would like to show it.  The only thing is that there buyer is a referral and that they have to pay 25% for the referral fee. The next thing the agent asks me is why am I not offering the standard 3% co-op and I'm doing a dis-service to my seller. The agent goes on and says that if I don't give them the standard 3% that they will not be showing the home. I proceed to tell the agent I didn't realize that 3% is standard and wouldn't it be a dis-service to their customer if they did not show all the homes that fit their customer's needs. Well, the agent gives me their number and tells me to call back if the seller will agree to pay 3% co-op.  

The way I look at it is that 2.5% of $400,000 is $10,000 in commission I think that's a great paycheck. Now, if I showed my customer a home that was at 2.5% co-op and it was the second or third one of a list of 20 home and they said to me we seen enough we want to write an offer on this one. I think that's great I would not be driving around the rest of the day looking at houses and it would give more time to prospect for more business.

Well, the end of the story is that the seller is only going to pay 2.5% and that the agent never showed the home.  Three weeks later we had a contract on the home from another agent and everything went smooth with the closing. The selling agent was so happy that she found her buyer a home that the 2.5% co-op did not matter to her. That's the way things should be you should look out for your customers best interest.

That is the type of buyer agent that gives all of us reputable agents a bad name!  Did you report him/her to their broker?  I think they neglected their fiduciary duty to their buyer- shameful!

I spoke with my broker and local board but really did not push the issue. I was getting alot of showings and felt it was their loss. I felt like if they were going to complain about the commission it would be better for me and my seller not to have to deal with the agent.

I have been known to take a 5% commission from time to time, but I ALWAYS take the full 1% hit on my end.  Do I think it is right that agents shop their commission?  NO!  Do I think it happens all the time?  Probably so!

I would hate that a potential sale would be held up on commission.  I say "2% of XXX,XXX is always better than 3% of 0"

I think that is a disservice to the potential buyer... Their agent is working in the best interest of the agent not the buyer. I once sold an acre lot with a 1% buyers commission and I asked the listing agent if the seller would consider a 3% co op. The listing agent told me that the seller would not be able to do so. Instead of jeopardising the offer I went ahead and wrote it without asking for the increase in commission. Long story short, the title company called to confirm commissions and asked if 1% to the buyers agent and 5% to the sellers agent was correct? I was furious. My buyer bought the lot and knew nothing of this nor did I mention it to my client. I did have a few choice words for the Listing Agent though!

Robert - Sounds like an ethics violation to me.  Without a complaint being filed, this "clown" will be out there doing this again someday....

I think an agent has an obligation to show his buyer everything available regardless of commission. Having said that I'd do 2.5% on 400K any time, once or twice a month would be really nice.

Robert - I completely agree. I know some agents deliberately DO NOT show particular homes because the commission split isn't to their liking. It's NOT about us and the commission. It's about relentlessy representing our client's best interests. When pulling up potential listings, I never look at the commission amount. I am too busy trying to find just the right property for my clients!

A greedy agent lost out on 10 grand.  Co-op should not matter, what matters is the client.  If you are driving the client past homes and not showing them, I bet the client goes home and gets on the net or calss that office that had the listing you drove past, and you lose the cliet over  1% or less

i thought all commisssions were negotiable and that realtors would get into big trouble for taking about standard fees, or eveybody charges that. never mind i won't show the property if i don't get the standard.

i'm just a lender, what do i know.

Well Robert if it makes you feel better NEFAR basically told me, the broker, "We really don't want to get involved".  By the way it was an Orange Park agent that actually left a voice mail for the sller to list with hom, the listing was less than two weeks on the market.  Wonder why so many agents are out of control?  Perhaps OUR association is to blame.

Holy moly! Unbelievable! The agent was definitely doing his buyer a disservice. That's just plain dumb! It's totally worth my time to shop the RIGHT houses for my buyers! Who cares what the rate is! It's money! It does give us a bad rep!
