Bravo, Mark!  Your catchy title caught (excuse the pun) my eyes!  It makes no sense to me why buyers refuse to sign buyer's representation agreements.  However, it does happen. After a few unpleasant experiences, I make it a practice not to work with customers who refuse to sign with me as their buyer's agent.

In my experience the buyers always seem to be worried about the part of the agreement where it says that if the commission to be paid isn't paid by the seller, the broker has the right to collect the commission from the buyer.  They always seem to be fine with the buyer's agreement until we get to that point and then you see them start to get nervous.  Even though in the paragraph above that statement it says that every effort will be made to collect the commission from the seller first.   I had one buyer tell me that he didn't need to sign one because he was paying cash for the property and since he was going to be closing on the property so quickly, it wasn't necessary.  Granted it was a very fast deal, we made the offer and closed in less than two weeks. 

Although I make every effort to have one signed with every buyer I work with, sometimes it doesn't matter if you have one.  I had a buyer's rep agreement with an older couple who were looking to purchase a home.  In the section where it states where I would help them find the home, I listed the counties surrounding and including Palo Pinto, which is where we live.  As it turned out, they went out of town the first weekend after signing the agreement and bought a home in Lubbock, which is about 5 hours from us.  Said they just couldn't pass up the house, it was their dream home.   

You just never know what is going to happen.
