Buy insurance or go to jail - Obamacare official!

Yes you read that right. Under Obamacare you are forced to buy it. If you don't you can be fined. Now we know that if you don't pay the fine, jail awaits you!

Truly, you can't make this stuff up. It comes down to this. Americans who fail to pay the penalty for not buying insurance would face legal action from the Internal Revenue Service, according to the Joint Committee on Taxation.

Senator John Ensign (R-Nev - pictured left) wanted to know what that meant and so he asked a question of the committee's Chief of Staff - Thomas Barthold and was shocked when he received the answer in a hand written reply. The answer is simple. Pay up the fine or face prosecution from the IRS. This can be a fine of up to $25,000 and a year in jail.

Apart from being shocking, this answer blows up the President's continuing claims that the individual mandate penalty, which could go as high as $1,900, is not a tax increase.

The Senator pushed the line of questioning, he later explained, because neither he nor Americans that he had spoken to, believed there was a provision in the Constitution that allowed the Federal Government to mandate that you and I buy health insurance!

"We could be subjecting those very people who conscientiously, because they believe in the U.S. Constitution, we could be subjecting them to fines or the interpretation of a judge, all the way up to imprisonment," Ensign said. "That seems to me to be a problem."

It seems like a problem to me too John, but the problem does not end there. It would seem that the Senator's colleagues don't agree - refusing to sign on to an amendment to dump the mandate.

Not surprisingly, all the Democrats voted in favor of keeping the mandate and perhaps even less shocking is that Republican Olympia Snowe (Maine) also jumped on board. Someone needs to explain to these people that we have a little document that I like to call "THE CONSTITUTION" and that if they don't want to abide by it, then get the heck out of OUR CAPITOL! Simon...looks like I will be going to jail at some point in the near future.....but I suppose I will get free health care while I am there!

Here in Calif you get Cadillac health care in jail. The feds mandated it.

We already get fined in Massachusetts for not having healthcare.

At this point, Simon, no outrage or leftist agenda item is a surprise.

The Congressional elections of 2010 are vital to stop the madness and the abuse of power. With a net change of only 21 seats in the House we can keep a finger in the dike until 2012 and remove Speaker Pelosi into the bargain.

Simon........while I don't think that the "jail time" provision should be included, I don't think anyone should be very worried. We are still reeling from the results of hundreds of thousands of cases of loan fraud. Very few people have been investigated. Fewer have been charged. Convictions are abysmally low when compared to the statistical probability of the number of times the offenses were committed.

Before the whiz kids figured out that they could use superficial underwriting to get anyone approved for a mortgage, loan fraud rules were in place. Almost every buyers agent that sat at settlement and watched their client sign that they would occupy a residence as a primary residence knew the veracity of that statement. Every agent that sat in silence, knowing that the statement was false was complicit in loan fraud. Every one of them knew the potential penalty. Not many of them are serving jail time either.

A person who makes a misrepresentation on a loan application in order to qualify for a mortgage has committed fraud. While many people consider this sort of action to be a harmless “white lie,” there are serious consequences for mortgage loan fraud. The first consequence involves your mortgage itself. As soon as your lender discovers a false statement, it can call the loan balance due. If you are unable to repay the loan in full, the lender can try to seize your property. Additionally, mortgage loan fraud is a federal crime. There is a chance that you could be prosecuted, and if you are convicted the consequences are harsh. Penalties can include fines and jail time. Even if you avoid criminal prosecution, mortgage loan fraud can be a type of financial suicide. Your credit history will contain a horrible black mark for years. Also, it may prove impossible for you to secure any future loans from reputable lenders.

Our judicial system is over whelmed and there is a practiced system of ignoring obvious crimes. The only way I believe anyone will go to jail for not following Obamacare directives is if the crime is somehow linked to a terrorism plot.

Angelo Mozilo continues to walk the streets, a rich and free man without being held accountable for any fraudulent loans that occurred on his watch at Countrywide. Flaxeco Burris shot himself in the leg and is on his way to prison.

Bad policies do not always result in the consequences trumpeted upon their arrival.

J-Mac - while your point is kind of valid, it does not change the fact that this is terrible law. I believe it's unconstitutional and even after having it pointed out to them, they passed it anywa. Don't expect any action on mortgages when you have Chris Dodds and Barney Frank right at the center of things. Oh and CALL ME! I've left you three voicemails. Simon - but what I expect first, since the IRS will be handling this tax, is that all assets will be frozen, similar to what happens now in some tax cases.

Everyone should be concerned about stuff like this in the bill. It DOES say that you must have insurance and that Violators could be charged with a misdemeanor and could face up to a year in jail or a $25,000 penalty

It sounds like imposing penalty on the homeless since they're not purchasing homes.

This just becomes more ludicrous every day, in the meantime Obama is ignoring one of the few things the government is supposed to do, protect our borders and oversee our military forces. Sounds like we are losing ground in Afghanistan while ruining our health care system. Unbelievable!

Simon, The fine for not having insurance is just one of 8 consequences that amount to "taxation" under a different name contained in the bill.

2010 cannot come fast enough.

This could be just what turns the tide for folks to start jumping off the Obama worship wagon.

But at least in jail you'd get 3 squares and some sort of medical coverage, wouldn't you think? What are they going to do? Arrest everyone who refuses to participate? Ridiculous.

I am one of those people who chooses not to have health insurance. I have catasotrophe with a huge deductable. I don't go to the doctor. Once a year for a pap and breast exam and blood work. Any time I need health care I go to either my chiropractor or my homeapathic doctor who also does accupuncture. None of those are covered so I would be paying for coverage I don't use and still pay out of my pocket for what I choose to get. I have not ever taken prescription drugs. I don't take over the counter meds. I use only homeopathic remedies and herbs. Of course those are not covered nor do I want them to be because if they were Big Pharma would take them over and they would no longer be natural. So I will go to jail for refusing to pay into their stupid medical scam run by Big Pharma, the FDA, the FTC and now The IRS!

How will they fit all of us in the jails? They can not even keep the criminals in jail. This jail time thing, another tangent for me. I so disagree with putting so many people in jail because we have to pay for them to be there. Jail is for violent criminals, pedephiles, rapists, etc.

But you know a congressman today just came out and said we should go to jail for exersising our first amendment rights because no one should ever be allowed to say something not nice about another person! OH MY, the jails would be overflowing. But then again, Woodrow Wilson put over 130,000 people in prison for speaking against him, political prisoners.

To be fair, the American tax payer spends way to much money on subsidized health care right now. If we do away with Federal Employees insurance, Medicaid & Medicare and all the rest. Allow the Health Insurance companies to control all health care benefits in the USA and compete for our business to drive down their costs.

When you think about it, at the present time there are millions of tax payers who already help subsidize health care for Gov, State & Fed employees, but get no subsidized health care option in return. We should level the playing field!
