Ban On Hand-Held Devices Starts In October

McGuinty Government Making Ontario's Roads Safer

Ontario's ban on hand-held devices while driving will take effect on October 26, 2009.

The new law will make it illegal for drivers to talk, text, type, dial or email using hand-held cell phones and other hand-held communications and entertainment devices.

Following a three-month period that begins October 26, where the focus will be on educating drivers, police will start issuing tickets on February 1, 2010.

Studies show that a driver using a cell phone is four times more likely to be in a crash than a driver focused on the road.  Other studies show that dialing and texting carries the highest degree of risk of all cell phone-related activities.

Police, paramedics and firefighters will continue to be allowed to use hand-held devices when performing their duties. All drivers may use hand-held devices to call 9-1-1.

QUICK FACTS

  • Under Ontario's new law, fines of up to $500 can be levied against distracted drivers who text, type, email, dial, or chat using a prohibited hand-held device.
  • Ontario joins more than 50 countries worldwide and a growing number of North American jurisdictions that have similar distracted driving legislation including Quebec, Nova Scotia, Newfoundland and Labrador, California and New York.
  • Teens and young people under 35 are the most frequent users of cell phones while driving.

As you may know, California already implemented the ban of cell phone use while driving. Even though I'm on the road a lot I think it has been great. I was truely sick of seeing people talking on their phones in almost every other car I approached prior to this law being passed.

Hi Diane: We have had such a ban in CT for years now.  I don't think it has made much difference but it is still a good law!

 Tina,

I am looking forward to this. Fines unfortunately don't start until Feb 1, 2010.

When 80+ year old ladies are talking on cell phones in the outside lane of major streets, it's definately time to put a stop to this madness.

 Matt,

It is estimated that 35% of our accidents are due to cell phone use. I live in a city of over 3 million people. This will definately make a change for the better and the fine will be $500.00-not shabby

Diane, The thought of drivers texting on the 401 at the Mousetrap (or anywhere) is positively insane.  Good for Ontario for cracking down.  We need to do this in Florida as well.  Good localism post!

Marcia,

I agree with you that cell phones should be banned in Florida. It is a state of aging population and the thought of an 80 year old texting or on the the phone on the 75 or 95 is frightening. Someone was texting with both hands on Airport Pulling Rd, turning a corner and almost sided us.

We wrote your Governor to ban cell phones in cars but we got no reply.

Diane,

I just witnesses a rear end collision on the 410 in bumper to bumper traffic at less than 15 km/hr. a few days ago.

The fellow was on the phone.

I never make calls when I'm driving. You can always pull over to the side of the road.

While playing videos games while eating and talking on the phone may be a skill to deem worthy to boast about, those activities take place in the safety of one's home...it's a different story when you're on the road in a vehicle and running the risk of endangering your life as well as those around you. Roads in Canada, especially in the winter, can be dangerous enough. I'm glad this law is coming into play and hope it'll help lower the amount of accidents and bad driving. Thank you Diane for posting about it.

Re comment from eludz

I am absolutely incensed that that someone this ignorant would actually post a comment like this. It is for this reason that the Ontario Government as well as 17 states have cell phone bans and 18 states have texting banned. 46 Countries in total have banned the use of cell phones while driving.

This person is someone who will cause an accident, kill someone and turn around and say "It wasn't my fault". Perhaps it will be their own family member who was unlucky to be in the car at the same time.

I am appalled that this person would use swear words in a public forum. It is OK to state your opinion in a logical manner, but don't swear-it does not make your case. The older generation did not run from video games and are not challenged technically and are not over medicated.

Society is free until too many people cause harm to the rest of us and statistics prove some controls need to be put in place.

Diane, Sorry about your incident in Naples.  This whole phenomenon of always having to look at your phone for messages and texts is alarming.  I am sorry you did not get a response from Gov. Crist.  Good for you for writing.  Hopefully some day the public outrage with be strong enough.  Happy Thanksgiving!  ;-)

 Marcia,

I hope more people will start using hands free in Florida.

Thanks for the Thanksgiving wishes. As you know it's no big deal here but I am having the family over for Turkey.
