BIG SOUTH FORK TENNESSEE: No Horses On The Grass? No Way!

By
Real Estate Agent with Tennessee Recreational Properties

No Horses Signs On Grass Are Not Correct!Occasionally, visitors to the Big South Fork area get lost while they are out riding and may end up traveling along the road, trying to get back to wherever they are staying. Sometimes riders may need to consult a map or tighten a girth. If so, the right of way is their "breakdown lane."

There has been a proliferation of "Horses Keep Off The Grass" and "No Horses On The Grass" signs in this area in recent months. Big South Fork National Park is considered the best trail riding east of the Mississippi and is called "The Trail Riding Capital of the Southeast." Many local businesses advertise in publications such as The Trail Rider magazine in an effort to attract visitors to the area. Not only are such signs unwelcoming and offensive, they are incorrect.

The  RIGHT OF WAY extends a minimum of 25 feet from the centerline of the road, in either direction, on State Highway 297 and, in some places, it is fifty feet. That means you have a perfect RIGHT to stand on the grass or ride on the grass as long as you remain within the right of way.

You You Can't Keep Anyone Out Of A Public Right Of Way!

Leslie - The right of way is misunderstood by most homeowners, and this is most often seen in subdivisions where property lines usually begin about 10' behind the curb.  Most property owners view their property as extending to the street--they maintain it, plant grass and shrubs--but, as you point out, it belongs to the city, county, or state.

I would have to bet it is not the horses but the horse manure that is the reason for the signs. Home owners have to mow that area of the right of way, so I could just bet this is the motivation of the home owner to not get (you know what) on their lawn equipment.

Hi, John. I...and other agents...have lost many a realtors' sign when the county or the state does periodic mowing. Hopefully, the road crew just tosses them onto the truck and takes them back to their facility, where they can be retrieved. Sometimes they are pretty mangled but other agents have picked up my signs when they're picking up theirs and I have returned the favor. I've learned to be far more conscious of what the right of way is!

Hi, Mary. That may be but this area is a destination for trail riders and with horses comes....horse poop! As I see it, manure is a sign of prosperity (no pun intended) and I would be ENCOURAGING it, not discouraging it!

You tell them girl!  They are not going to tell you "no horses" and get away with it any time soon!  Way to show'em you know your rights!

Leslie - Regarding the signs, it is illegal in most areas to place them on the right of way, and in my area when they pull them up, they destroy them.

Whoa, John...new picture! We are here in Mayberry RFD where people are still pretty decent and they know that signs cost money. In turn, I am careful not to cause more work for the road crews!
