Who's responsibility is it to take out the trash? Is it the landlord or the tenant?

In Crescent City, CA, a new Ordinance has been passed that puts landlords responsible for the trash that accumulates in rental properties, even though the trash came from the tenants.  This law seems unfair to landlords as tenants can take advantage of this and not take care of their own trash.

So are the landlords' concerns valid?  There has to be a balance for this between the tenants and landlords as to who is responsible.

This strikes me as a bad law. People should be responsible for taking out their own garbage. Should landlords also make their bed and flush their toilets too? I'd write it in the lease to circumvent this.

Yes, I agree. Landlords should monitor their properties and inform the tenents, but they should not get all the blame since it is the tenants' solid wastes, not the landlords.
