Landlords Must Follow New Oregon Laws

I am a Landlord so it is wise for me to keep abreast of laws that can affect my investments. I will offer a summary of these laws, as I understand them. Further investigation is required on your part.

Starting Jan. 1, 2010 Landlords must disclose their smoking policy in writing.

HB 2393 doubles the fees Sheriffs can collect for performing legal duties.

SB 777 creates a 60 day no-clause notice for terminating a tenancy. Ouch!

There are new laws governing abandoned property.

A Landlord may not charge a pet deposit for a service animal or charge a cleaning fee.

I have only touched on the residential laws that affect me directly. There are several more bills that affect other types of real estate.

Oregon laws heavily favor the Tenant. It's essential to know what is new.

Washington law tends to favor tenants as well, some city's pass laws that are even more strict than the state laws.  A landlord needs to be very vigilant to protect their interests.

So what's a service animal Wayne?  Answer:  Any animal you want to call one...under federal discrimination rules.

You can ask:  Is that a service animal? What service is it trained to do?  You may ask no other questions.  You must accept any answers given.  That's true even if you are running a food establishment...so you can better bet it will apply to rentals/renting/leases.

Tigard, I don't know what the wait time is here to get a tenant out but I know it is LONG.  60 days is definitely an "OUCH."  My mother has a legal apartment and we are afraid to rent it because of this issue...

I think a service animal is really only the dogs for the blind and the dogs for people with seizures.    Wow the 60 days is a big OUCH.
