 If your clients asks if a house or building is Haunted, can you tell them?

 State Regulation across the country are different for disclosing if properties are Haunted or there has been a suicide or murder.

 What are your State Regulations for clients asking you questions about these subjects.

 In the State of Nevada it is a (No-No)! You can be fined and loss your license for disclosing such information.

 Now on the other hand this building above the Goldfield Hotel in Goldfield Nevada is not for sale. And so I can tell you it is Haunted big time, (Ghost Busters) television program was visiting the Goldfield Hotel several months ago and there is so much Ghost activity going on around there it would make your head spin!

 You know kind of like "The Exorcist" with Linda Blair.

 The (photo below) is another very, very Haunted building in Goldfield, the school right next to the police station.

 This lady I spoke with mentioned to me that police officers are always viewing and hearing very strange activity coming for the school.

 And the home below on main street in Goldfield, very, very haunted!

 And my last photo below is Haunted and I really like this one because if you look real close you can see the glass bottles used to build the walls sticking out the sides.

 So if a client ever asks you if a home/ building is Haunted or if persons have been murdered or committed suicide in the home/ building, you better know your disclosures in the State where your license hangs.

Hi Bob,

I actually did an offer this week on a home where the owner had committed suicide in the garage 6 months ago.  The bank now owns the property.  Believe it or not my people actually competed on the property.  The listing agent must disclose this information if it is known, as a pertinent fact.

For sure the neighbours will be telling them also.

VB - yes, err, no, err, maybe... LOL. We have a famous claimed to be haunted house for sale around here - bank owned at that. It's been on TV etc. not sure how anybody could miss it's claimed to be haunted... ~Rita

The bottle-cottage doesn't look haunted...just drunk.  The school doesn't look haunted...just in need of an extreme exorcism.

Hi VB, in CT we, as Realtors, are obligated to disclose material facts about a home. However.... the law says we also have to disclose pertinent facts that would important to a "reasonable buyer". What I think might be a fair release of information the courts might not, and they may not think it reasonable that someone needs to know if a murder or suicide has been committed in the home. 

Because our laws are so ambigious I went to the Connecticut Association of Realtors License Law and got this information directly from there:

Sec. 20-329cc. "Nonmaterial fact" defined. As used in sections 20- 329cc to 20-329ff, inclusive, a “nonmaterial fact concerning real property”

means a fact, set of facts or circumstances surrounding real estate which includes, but is not limited to: (1) The fact that an occupant of real property is or has been infected with a disease on the list of reportable diseases issued by the Commissioner of Public Health pursuant to section 19a – 2a, as amended; or (2) the fact that the property was at any time suspected to have been the site of a nonmaterial fact death or felony.

Sec. 20-329dd. Nonmaterial fact. No disclosure required. No cause of action. (a) The existence of a nonmaterial fact concerning real property is not a material fact that must be disclosed in a real estate transaction.

(b) No cause of action shall arise against an owner of real estate, the owner’s agent or any agent of the transferee for the failure to disclose a nonmaterial fact concerning real property to the transferee.

Sec. 20-329ee. Purchaser or lessee written disclosure request. Notwithstanding sections 20-329cc and 20-329dd, if a purchaser or lessee of real estate, who was in the process of making a bona fide offer, advises an owner of real estate or his or her agent, in writing, that knowledge that the property was at any time suspected to have been the site of a homicide, other felony or a suicide is important to the purchaser’s decision to purchase or lease the property, the owner through his or her agent shall report any findings to the purchaser or lessee, in writing subject to and consistent with applicable laws of privacy. If the owner refuses to disclose such information, his or her agent shall so advise the purchaser or lessee in writing.
