Homeowners Association.... The Good, the Bad and the Ugly.....

Many prospective home buyers are not aware of the impact of buying in a Homeowners Associaiton (HOA) 

Many see the GOOD but many times don't see or understand the possible BAD or UGLY.

Living in a HOA can have benefits that you may not be able to afford.  

For example, walking trails, club house with an exercise area, hot tub, swimming pool and large common areas for family gatherings.

There are normally minimum maintenance standards.  These can enhance the overall value of the area.  Including your homes resale value.






There are those that feel they don't need to follow the rules and regulations or that they don't need to pay there monthly HOA assesment.  

That can put the financial burden onto the other home owners.

Some don't see the need to maintain their property.

Strong fair HOA management is necessary to enforce the rules and regulations of the community.


Many times the HOA  Declarations state the buyers are jointly and severally liable for past due assessments.

This can mean if the person you brought the property from hasn't paid the assessments (consult your attorney for specific interpretation of the specific HOA rules). You as the new property owner can inherit the liability for the past due assessments.  

Does it really happen?  Yes, I know four home owners that were notified of this issue last week.


The moral of the story:

Make fully informed decisions when buying a property in a HOA.  Understand the rules and regulations governing the HOA.  Make sure you can live with the limitations of the HOA.  The rules and regulations will commonly be different in every HOA.

Obtain the latest finanical statements and HOA annual meeting minutes.  Talk to current home owners and the President of the HOA.


I live in a HOA and enjoy the benefits.

Should you choose to live in a HOA.  Be active in the management, attend the meetings and understand the rules and regulations that govern the association.

The even uglier can be when members of the association can't seem to get along. I have seen some truly nasty personal battles in our association. Unfortanetely, there are rarely any winners in those type of situations.

Sure, some HOA are great if you live behind a walled one with a golf course. But if you live in one that isn't walled up or if you live in one where the developer as had control for over 40 years and keeps hanging on just because they still own the common area/greenbelts so they can stay on the HOA board. Plus the fact you have board of directors who haven't a clue but they do have power and enjoy ever minute of it because lets face it these people will never hold public office, the hoa management companies enjoy that the hoa attorneys love it too. And all along your by-laws are complete gray areas and you can never change them because the developer had his attorney change the original documents so the homeowners can never vote on the by-laws. Better yet people do you really want this type of life, keep you freedom there are plenty of homes out there that are not in a HOA by those home you will love you freedom to do what you want like plant a garden change the color of your home when you want and the color you want the list goes on. Don't by into the lie of an HOA take back you freedom and really live that dream in your own kingdom with your own rules.
