It's not often this Gainesville, VA Short Sale Listing Agent complains about Wells Fargo, but today is one of those rare days.  You see, in my experience listing Wells Fargo short sales, and working with their negotiators toward short sale approval, their time frames are reasonable and their staff reliable....

UNTIL TODAY.

My short sale seller had already lost one set of buyers who were under contract to purchase his home.  And once we had short sale approval, they bailed.  The buyers wanted to renegotiate the sales price that had already been approved, down lower.  I alerted Wells Fargo to this fact when I sent in our SECOND contract that offered Wells Fargo the exact same net price. 

That second contract was faxed to Wells Fargo on November 24th.  On November 20th we were assigned our "new" negotiator.  I called every few days to ensure that we were on her radar, asking the call center employees to take my notes each time, and send them in an email to my negotiator.  Evidently, the negotiators decide for themselves whether the call center can release their contact info.

So yesterday, January 4th, the second trust, who the week prior sent approval of the sale to us, called to follow-up.  I informed them I was having zero luck getting my negotiator's attention, and didn't have their contact info.  I dropped the negotiator in quetion's name and was surprised when my second trust negotiator gave me her email and direct phone number.

Sadly, when I made contact with her directly, I was informed she was a CLOSER and couldn't approve the file.

That's okay.  She was probably going to refer us back down the line to our former negotiator.

Nope.  Her reaction was to CLOSE THE FILE.

Not even this problem, while aggravating as all get out, is enough for me to declare failure.  I was on the phone with the Wells Fargo short sale call center immediately, got a supervisor, and had a direct fax number and phone number for that supervisor within minutes.  The contract was resent directly to the supervisor.  Whether we get a reprieve from the standard Wells Fargo short sale approval time frame is yet to be determined.  If I have anything to do with it we will.

The sad fact that the call center employees do not know what TYPE of negotiator you are being assigned is really a statement of how little these employees, that short sale listing agents like myself are forced to work with, really do not know, or understand of the short sale process.  I think it's time for Wells Fargo to bump it up a notch and train their personnel to know when something has derailed.  If not, they are quickly going to have established a short sale reputation similiar to that of Bank of America.

Cindy:  I'm sure you meant phone when you said fun.  I'd say it's a Freudian slip, but I don't think these types of calls are fun.  :)

Chris Ann, This has to be totally exasperating!  I have a couple of buyers I'm working with when I get back who might wind up making an offer on short sale listings.  I'm not anticipating it my usual glee.

Hi Chris Ann-I don't envy you all the work, stress and frustration that goes along with short sales. The lady I work for has one short sale that is with Bank of America and it is a nightmare and it hasn't closed and they put an offer on it in July. On Christmas Eve mind you she had to fax 79 pages worth of documents that she has already faxed them 14 times before. That is BEYOND ridiculous. That is plain STUPID. I have a lot of admiration for all the work you do with short sales. I hope your day is better tomorrow.

P.S. Sorry it isn't a kitty. <SMILE>

I don't know how you deal with all of the frustration. Short-sales are really hard work, so it takes dedication and persistence, both of which are qualities that you possess!

Hi Chris Ann,

Short Sales are going to drive us all the drink! I have three short sale listings under contract now here in the Woodbridge Virginia area with Well Fargo, SunTrust, Bank of America and Midfirst Bank . I feel your pain... ?

"Why the heck did Wells Fargo open a new file with a new negotiator? There was nothing to Negotiate if the net was the same ! Wells Fargo already made a promise in writing to all parties by issuing the Short Sale Approval Letter." 

Like you, most of us who deal with Short Sales will always make sure there is a backup offer for our homeowners short sale listing just in case the first buyer withdraws. Big Banks cannot expect a home buyer to wait 3,4,6 months or longer for the bank to issue a seller Short Sale Approval.

A new contract with a name change and the same net to the bank, that can settle within the timeframe issued on the Short Sale Approval Letter, is a reasonable request. This is something a Short Sale Negotiator should be able to rubber stamp without having to start the entire process over.

Goodness...keep up posted on this one.

Chris Ann-  Hang in there and keep us updated on the progress.  I, like you, do mostly short sales in my area.  I am fortunate that I have not run into issues with Wells Fargo as of yet.  On the otherhand, as you implied, BOA is another animal.  I have had several transactions with them that have lasted well into the 6 or 7 month timeline.  Frustration is putting it lightly.  One day the banks are going to look back on all of this and wonder "why couldn't we have made this much easier for all involved?"

Robert:  Having had worse situations turn out fine and go to settlement, I can see the light at the end of the tunnel.  The very first short sale that had an issue like this, I was in a panic.

Peggy:  I think you and I are squarely planted in the camp of common sense.  Wish we could the bank's negotiators there too.

Jackie:  In business my patience is seemingly endless.  Somehow, in my personal life, I run short on the stuff.

Terry:  Banks are already begging for Realtors to pursue short sale listings with folks that would otherwise go to foreclosure.  If they want the sellers to take this option, they really are going to have it make it easier.

Liz:  I do get the feeling that Wells is headed downhill.  I really hope not, but that's the vibe I'm getting.
