I have an acquaintance of mine that has her home listed with another agent in an exclusive agreement. She told me she is considering changing brokers. She asked me to come view her home & tell her what the comparable homes are listing for.
Can I answer these questions for her, much less go to her home while she has it listed with another agent?
What if the other agent sees my car there? Do I need to get permission from the other broker?
This poses a good ethical question. I'm sure this has happened to many agents and most probably aren't sure how to answer it.
Answer:
It is not a violation of the Code of Ethics for you to go on the listing call in these circumstances. Both standard of Practice 16-6 and Standard of Practice 16-13 address this question.
"When Realtors are contacted by the client of another Realtor regarding the creation of an exclusive relationship to provide the same type of service, and Realtors have not directly or indirectly initiated such discussions, they may discuss the terms upon which they might enter into a future agreement or , alternatively, may enter into an agreement which becomes effective upon expiration of any existing exclusive agreement"
The Realtor can go on the call, present a CMA and discuss a future listing with the acquaintance.
