Volusia County and our local muicipalities are now requiring Realtors to have occupational licenses.

Volusia _County_ LawFlorida State Law, Title XIV, Chapter 205, Sections 205.22,205.032, and 205.033 give the counties and municipalities the right to levy and collect a "local business tax on "any business, profession, or occupation within it's jurisdiction. In order for them to do this, they must have created the tax by local ordinance.

So now they have recently begun to exercise their right!

So according to the Volusia County Supervisor of Elections, any brokerage business, corporations, investors,sales associates, and schools are required to have a Volusia County Occupational License.

If inside the city, the city license is required prior to the county license.

Volusia County requires an annual license renewed on Oct.1 thru Sept. 30th. This is according to the county. Any questions can be answered by Mr. Roberts of Volusia County at 386-254-4614.

I wonder how many realtors know about this and DON'T do it anyway...

I know that there are always questions as to whether to get the OCC license in your municipality where your license hangs or where you do most of your business, i.e. home office...

David..Thanks for the response.I was told that it is in the municipality where our main brokerage office is located. That would be Port Orange FL.

That's right, the state law gives the municipality the right, but the municipality still has to create a by-law to that effect.  Real estate professionals should check with their respective municipality -- the by-law will either explicitly state those occupations which require licensing and/or exemptions.

Looking at the Volusia County web-site, it would appear they have their bases covered:

  • APPRAISAL (REAL ESTATE) or REAL ESTATE APPRAISER
  • REAL ESTATE BROKER
  • REAL ESTATE BUSINESS
  • REAL ESTATE CORPORATION
  • REAL ESTATE SCHOOL

The situation could get messier if Volusia considers an independent contractor's home office as a home business, and thus subject to additional county ordinances.  *ick*

In January, our real estate board (TREB represents 25000+ members) successfully lobbied the city against proposed licensing of REALTORs in Toronto.

Great post.. I did not know about that.. I know many years ago.. Bay county was doing something similiar.

Gosh wouldn't it be awful if they started with the independent contractor's office? Wonder if they could do that too!!

Local governments are really going after small businesses for revenue--guess it is easier to upset a few business owners than the general public!  Thank you.
