On the brink of a trustee sale...

This is hairy.

By the time I received a call about a potential short sale listing, the seller has already received a Notice of trustee sale in 3 weeks.

The seller's daughter had tried for 6 months to get ther loan modified, but it wasn't until Dec 31 2009 that they were told their applicatoin was denied.

January 25, they received a Notice of Trustee Sale scheduled for February 22, 2010.

She frantically searched for someone to help with the short sale from the time she received the Notice.

Feb 5, she called and told me that she found me ia the internet. We decided to meet in the afternoon.

LISTING THE PROPERTY AS SHORT SALE THREE WEEKS BEFORE THE TRUSTEE SALE

After meeting with the client, a sane agent would probably have said that this couldn't be saved.

But there was such desperation and angst in her face that I told her I would try. We signed the listing agreement, I posted on the MLS the listing for sale later that afternoon, and posted it on other sites, most notably Craigslist and Vflyer. I had to price it very aggressive, especially since there was a bank-owned property two doors down that was just posted a couple of days earlier.

By 9 am the following morning, I received three requests to show the property at 11 am. And by 1 pm we received an all cash offer and three other similarly good offers and terms. Sellers accepted the best and highest all cash offer.

Since then, there was a flurry of phone calls to Chase --- to their Loss Mitigation Department, their Foreclosure Department, their assigned trustee service. Fax after fax after fax.

THREE DAYS BEFORE TRUSTEE SALE...

Feb 19,  2 weeks after I listed the property, and just three days before the trustee sale, we received good news: we have a short sale negotiator. The representatives from the short sale department have already sent a note to the trustee to postpone the sale.

Whatever black hair I had left had all turned white. Now if the stress would have allowed me to lose 20 lbs, I would have welcomed it (Darn! No such luck!)

And we are just beginning with what could be a long, long journey.

Folks....please, please, please...don't wait until the last minute to get help! Many times, even Superman can't help.

Pacita...I have also had this happen, only my call was 4 days before they were to be out.  I found them a place to rent, but thatwas the best I coudl do in a short time!

I will say this... I hope it works out for your clients.... but I would be paying close attention to the forclosure roster. Once it's in the hands of a trustee you should make contact with the attorney as well. You might find that the tail is wagging the dog...

William --- this is another anecdote I can use to make sure people know there is help, but they need to know whom to ask, where to go, and when to act.

John --- believe me...we called the law office handling the trustee sale. They told us that Chase was the client and it would have to be Chase who should tell them to postpone the sale., Called Chase: each time I got a different representative, and each one had a different answer. Finally got to the right parties who sent the note to the trustee company to postpone. So yes, calling EVERYONE at every step is important.

Carol -- just heard from an agent who said he got the job to do a BPO. I'm helping him by taking the pictures myself, giving comps. He lives nearly 35 miles away! But at least I get to provide information to help justify the sales price.

Nice job on getting the offer and requesting the postponement.  I 2nd your plea to homeowners, allow as much time as possible to allow for the short sale to happen.

Ray --- i get to do this again for another short sale. We've been waiting for approval since August. Finally seeing the light, but the trustee sale was filed for March 5. >SIGH<

Jared --- it happens even to folks who do allow lots of time. To date, the only easy short sale I've ever had has been with Wachovia. Truly painless and stress-free!

Jim --- hallelujah. Trustee sale was scheduled for 12 noon today. At 9 am, we received confirmation that it was indeed postponed, and that we do have a short sale negotiator assigned to the file.

Great job! I'm in a similar spot. Have 1st lien approval with a sale date just a few days away and still waiting for the 2nd lien's approval. The 1st is telling me they can't postpone the sale date because they already postponed it once. How do you find out who is handling the Trustee Sale? If I can find that out I will make some phone calls too. Great post, thanks.
