My owner is a Realtor for Century 21 Award in San Diego's Mission ValleyThere is an advertisement in today's paper from an attorney titled “Homeowners suing banks.”

The title didn't exactly lead one to believe that the attorney was wanting to find homeowners who would be interested in suing banks, but that's basically what it is.

Following is the advertisement, and I didn't bother censoring his name and phone number.

There is one phrase that really bothers me. See if it bothers you, too, before scrolling to below the picture.

Homeowners suing banks

I don't have a problem with people providing legitimate services under the law, but the phrase that bothers me is about being "tired of paying on a loan balance that is higher than the value of" the home.

Tired? Gosh. I'm tired of paying all my bills. None of what I'm still paying on is worth what it was the day I bought it. Where's my attorney?

Hi Jim - There doesn't appear to be anything illegal about what he is doing, but I agree that it just feels kind of icky.  And I wonder about his encouraging people who have been foreclosed on to sue their lenders.  For what?  I don't get what their cause of action would be.  I know they are hurt and sad and maybe even angry, but those aren't grounds to sue.  I may be missing something.

And if in a year or two, the market takes off and everyone has "instant equity" again after a few months, will the lawyers for the banks sue the buyers for not financing more?

I have read all the comments, but since this post is rather old, rather than making comments here in my post to each and every one of you, I'll just let everyone know that I have read all the comments and if there are any questions, I'll answer those. Otherwise I'll simply post this comment and then head over to your blogs soon to visit and do some reading and commenting. I hope you'll have a nice welcome mat out for me!

I'm still fighting to get an escrow closed that was supposed to close last week. As soon as I get everyone to jump through all these hoops, I hope to get back to being more regular here at ActiveRain rather than waiting until the weekend to do all my posts and reciprocal comments.
