Love the new guidlines and the high fine. So how many people and or children are in danger from 1978 to 1982?
Thanks for the information Sharon. It's almost April, so we better be prepared for this new rule.
I still feel that this is yet another way for the government to collect money from people, in this way from the certifications contractors must have to work on homes built prior to 1978.
I've only had one client who was concerned, but that was because one of his little boys chewed on a window sill when he was teething, and it had lead based paint.
In the past I've asked inspectors how do we detect lead based paint. Most don't check for lead, then can't tell by looking at it. I would assume that most homes have been repainted a few times since the late 70s, but you never know. Like the client who told me, "Bought it with the rug, gonna sell it with the rug. It's a good rug."
And, when did you buy it?
"1975."
With that, I want to make sure that the rug doesn't have lead in it.

Thanks for the information...I was not aware of this and it's coming right around the corner.
Looks like we need to explore if there is a new disclosure form regarding this.
I just heard about this new lead law last week. This is a good move to increase any potential problems.
Tim, that's hard to say, but I never thought about the paint still being around after 1978.
Gary, I think this one is more on the contractors, but it will probably change our disclosures.
Kevin, it will definitely be another revenue enhancer.
Mary Jo, there is a test that the Contractor I know is ordering. You take a sample of paint and test it. If it turns a certain color, there is lead in the paint.

I'm confused. Who are these "Contractors" and what are they doing? Are the doing remodeling or renovations? Are they taking samples to provide results to Realtors, Buyers, and Sellers? Will Sellers have to renovate the property before selling if there is lead paint or is it just a disclosure issue?

The new law is well worth the little extra time us contractors need to take to make a safer workplace. Once we all get down the new way to do our job it will be second nature.If I for one as a remodeler knew how bad it really can be for children , I would have done this many years ago. After going through all the training to get certified it has become an obsession of mine to find out everything I can do to make this new way of working safe and easy. this is a good thing ,It is going to cost a few more dollars to do a job but there is no way around it.
those on the spot test kits do not work and are illegal in some states. if you use them you need to put the results in the property disclosure, just so everyone knows all paint made today contains a lead base still, even the paint at home depot , the goverment allows 0.500 mil per gallon. so once that spot test kit turns red you must diclose it on the buyers form or risk a fine for yourself
