I am not an attorney and there is no advice here. I am on the top floor of a building in San Jose and there is an excellent Bankruptcy attorney on the ground floor. So many times clients come to me for advice and we get on the elevator and visit the bankruptcy attorney together. So many times the client does not "qualify". There is a means test and there are income limitations for the straight or Chapter 7 bankruptcy. Then there are debt limitations for the Chapter 13 bankruptcy.
Sometimes the client is in a bad situation and cannot file immediately and must do some work and adjustments to qualify. This is so similar to the loan business. Many times a client would have to clean up credit to raise the score or payoff a debt to qualify debt ratio or save some more money. We were Mortgage Planning. This is Bankruptcy Planning.
