Beware of Nosy Neighbors!

We've all heard of them, and have often run into them. Who didn't laugh at famous nosy neighbor Gladys Kravitz on Bewitched? I even have fun stories of my own I could tell of my time spent living near some nosy neighbors. 

No bark beetles here!I had a close encounter with one nosy neighbor yesterday that almost torpedoed a pending sale.  It's not over yet but I am hopeful that we will get this one closed.  Cross your fingers and wish me luck with damage control this weekend.

Wednesday was the scheduled closing day on a home that my client has been trying to sell for more than two years  Cute home on a beautiful golf course.  Affordable, lots going for it.  I could have sold it a hundred times except for one problem.  The front door opened into the kitchen and laundry room area.  Enough said.

No bark beetles here!Finally, joyfully we got it under contract to close on April 14. Then an underwriting log jam delayed the closing until Monday the 19th, dang! 

Yesterday came a frantic call from the buyer's agent that the buyer had gone over to the property.  The buyer was also disappointed with the delay, having made plans to be moving in this weekend.  While walking around the yard, the nosy neighbor came over and proceeded to tell her, among other things, that there is a bark beetle infestation in the pine trees on the property and that THE SELLER ABSOLUTELY KNEW ABOUT IT!  Nosy neighbor showed the buyer a tree stump which, according to the nosy neighbor, was a tree that had been cut down due to the beetle infestation.

I called my seller, who was flabbergasted.  Although the home has been vacant for two years, she has had a company do ongoing lawn and garden maintenance the entire time.  They have brought any issues that needed attention to her and she has had them taken care of.  She is Conscientious with a capital C.  The tree stump, she said, was a tree she No bark beetles here!removed more than 10 years ago because this same neighbor kept complaining that it was going to fall on her house.

And then there's the fact that this home backs to a scenic, timbered Avondale Golf Course, with professionals who care for the grounds and landscape to keep it in spectacular shape.  Do you think there is any possibility that ONE yard on the golf course has a bark beetle infestation while all the neighboring trees do not?  Of course not.  Those bark beetle infested trees turn brown in a matter of weeks and spread like wildfire to surrounding trees.

My heart goes out to my poor seller.  Financially distressed carrying two mortgages for two years, maintaining this house well, being blessed with a sale in time for tax day only to see a delay, and now to be fearful that it may not close at all!  Hopefully the yard care guy will be able to overcome the interference by the nosy neighbor and reassure the buyer that all is well with the stately pine trees in this beautiful yard.

UPDATE 4/19/10:  Turns out that there is no bark beetle infestation.  Got the call that the buyers have signed and we will fund and record today.  Today is a GOOD day!

Oh No!!! Hopefully, once the buyer is assured about the beetle problem (or lack of) they don't instead back out because of the obviously difficult neighbor!  Neighbor control is probably one of the most tantamount issues we face at times and can really make - or break a deal.  Best of luck to you!

What a lose lose situation!  Even if the buyer looks past the beetle problem, they're going to have to live next to that type of neighbor.  UGH!

She probably just liked not having a neighbor for so long, she was trying to discourage anyone from moving in.  We've all seen it happen.  I'm happy to see your client was able to finally get this house sold.  Aye aye aye, two years of double mortgage payments.  I can only imagine!

Oy vey! If I were the buyer, I'd hightail it outta there! Not because of the tree, but because of the neighbor! You can always cut down a tree. Law enforcement might not agree with doing that to the neighbor! Great job saving this one.

I have had two experiences with nosey neighbours, and in both cases, it involved a grow-op. With one of these, I was trying to have an open house, and the neighbour came by several times, and scared away the visitors. It was true that the home was previously a grow-show, but it had been fixed up and approved by the city. This is a material latent defect, and there was no intent to ever try to conceal the property's history, and it was priced accordingly. This place did not sell, and I think it had as much to do with the quality of the neighbours, as it did with the previous grow-op.

In the second one, a neighbour came out to talk to a family while I was giving a private showing. He says: So your buying the grow-op... The owner claims to have no knowledge of this, (it was rented), and my observation of the townhome brought up nothing that would indicate there were ever pot plants there. I could not see anywhere there were patches for holes in walls, no hooks in the ceiling or holes where hooks were (or evidence hole for hooks had been filled), no damage to carpet, and no signs of mold. I did check with the city, and there was no record of there ever being a problem with that home. Perhaps the tenant did have a few pot plants, but it certainly was not a grow-op. After this, I was required to disclose this information to potential buyers, and again, it did not sell.

After reading most of the comments all I can add is that I'm glad to see it turned out to be a good day after all.  This was a doozy.  I wonder what the neighbor will do next.

All's well that ends well! 

We had exactly the opposite happen the other day. It was as though the neighbors and passers-by were on the payroll. Honest they weren't. But a couple sure seemed to go to work, as we were wrapping up our presentation, to make sure our buyers felt welcome to the new neighborhood.

I enlist the help of neighbors when I list a home. I have found that they are much more helpful when I ask them to think about anyone they know  who is looking to buy a home. It sounds like this neighbor didn't see the big picture, an empty house versus someone living there to keep it up. Whether she liked her former neighbors or not, her property will be impacted if this home doesn't sell at the market rate at least.

Marilyn -- right on!  All this sue happy stuff is so low-rent.  I can't believe your friends take this attitude towards someone who might be their neighbor!  No wonder people are so uptight everywhere you go.

Good grief, so many whiny, entitled babies in this country.  

This is so mean ( I don't care what the foolish neighbor did)


Your friends "say they are going to sue the pants off the neighbor and try to make him lose his house. "
