We see these signs or signs like it all over town.  We know people who have gotten the letters in the mail that make all kinds of promises.  The kind of promises that a desperate person in foreclosure wants to hear.  People who are behind on their mortgage payments looking for some kind of miracle to save their homes. 

I know as Realtors you are required by law to follow a certain set of ethical and legal practices or face stiff penalties.   These laws were of course enacted to protect the consumer on the single greatest purchase they will ever make.  It also assures the consumer that this Licensed Professional has had to meet a certain level of education in order to be licensed.  This of course if not the situation for Short Sale Predators.

These Short Sale Predators can make any promise they want in order to take advantage of an emotionally distressed home owner.   It is not about helping the home owner but rather it is about the bottom line.  How much can the Short Sale Predator make off of this unsuspecting and emotional person.

I am a Conservative and capitalist from the day I was born.  I all all about the American Dream and the Entrepreneurialal Spirit and that hard-work should be rewarded.  Making money in this world is a good think and drives the economy.  But at the end of the day you have to look at this type of practice and wonder just how ethical it really is.  But even more importantly should these people be allowed to function in this high stakes game without be licensed?

We read and hear the arguments that are being made by these Predators.  On the surface they all sound legit and even like they just maybe a bunch of good folks who really care about their fellow man.  Heck it is legal so what is the big deal?

This will be open for debate for a very long time and I am sure will stir some debate on here.   Quite frankly that is why I wrote this blog article about it.  Personally I think if a person or company is buying more than a couple of properties a year then they should be licensed just like a Real Estate Agent.  They should have to live by the same moral, ethical and legal standards as any licensed Real Estate Agent.

In closing let me say this.  I do not believe that every short sale in this country done by a non-licensed person is a Predator.  I think there are some folks in it to make some money but they want to help as well.  I do believe that the majority of these people are Short Sale Predators and because of their less than ethical behavior should be licensed to protect the consumer.

LOL.. I love the title of this blog. Those tow truck drivin bottom feeders shouldn't be licensed, they should be lumped together in one group and defined so the public knows who they are. Wait.. that's already happened!

In Idaho, you do need to be licensed with the Department of Finance to negotiate short sales on behalf of someone else (with a few exceptions like a Realtor for their own clients).

I work with lots of short sale investors. They send out the postcards, hang the bandit signs and run the infomercials. But, I do know that they all do the following (or at least the ones I know):

  1. Inform the seller they are an investor whose interest is negotiating the lowest price possible to flip (seller signs acknowledgement)
  2. Offers free eBook of options available BEFORE they decide to short sale
  3. Has in-house staff consisting of:
  • Buyer's agent
  • Seller's agent
  • Negotiator
  • Transaction coordinators

I know there are some bads one out there but I am forturnate enough to work with those who are doing it as legit as they know how to.

Until they are licensed, homeowners need to be equipped to be investigative and informed in their decisions (which is where we can come in).

I think that the investor short sale is dying a quick death. Banks just do not want anything less than retail price for their properties. Now, on another matter, your 'like' button is in Spanish. Did you do that or did it just happen on its own?

For just buying houses, I would say no. But if someone is offering debt relief, there should be some regulatory controls. Very thought provoking!

Wayne: I am curious if you have even a single example of a person who actually is a short sale "predator" as you call it? Most of the people I see complaining about this are agents who don't understand the process and are full of sour grapes. I have yet to run across anybody who fits what you describe. Certainly you are not offering a blanket description of all investors who do short sales, I hope. Because a lot of these people are heroic, IMHO.

Aaron thank you for the comment and you have a beautiful family.  Are you involved in short sales yourself?  I am certainly not saying that all investors are predators.  In fact I know several that are involved in this process and they are decent people.  But I think calling these efforts "Heroic" is a real stretch!

I think some regulation is required.......I also believe that being a Real Estate licensee is sufficient. Perhaps all we need are some guidelines? If we do not come up with some, the potential lawsuits that come about from this will.....

Wayne: Thanks for the follow-up comment. I agree that many investors involved in this are far from heroic, but I've known of many cases that the negotiators I use have stopped foreclosure for people within a day or two of a sale. It doesn't always work, but it does on occasion -- and I think that is pretty heroic, considering what so many homeowners are going though. I have been involved directly with short-sale negotiations with lenders (admittedly not involving investors), and it is no barrel of monkeys for sure!

But your point is well made in the sense that I see a LOT of predatory marketing material on Craigslist and wonder what is happening to people.

Disclosure is the key. Most investors that I know, who buy from individuals disclose in the beginning that they are investors who are buying at wholesale with the intent on selling for a profit.
