Katy Residents Wrongly Charged Tax on Utility Bills. Are You One of Them?

This may not apply to you, but one of my customers sent it in and I thought I would share it with you...

If you don't live within the city limits of Katy, you are eligible for the removal of the city sales tax and the Gross Receipts Tax from your utility bill. Cinco Ranch is not in Katy city limits. I requested a note from the city of Katy (Charlie Shafer, cshafer@cityofkaty.com) confirming that we are not in the city limits and sent it to the utility with a request for the tax removal. I just got a $150 refund for the 3 years I was charged the tax. I imagine the same would hold true for Richmond too. Good luck!

The key on the Gross Receipts Tax is whether or not you live in an "incorporated" city of 1,000 or more.  Those who live within the CITY LIMITS of Katy (or Richmond, Rosenberg, Houston, etc) would be subject to the Gross Receipt Tax as those are incorporate towns of 1,000 or more.  Those living outside the city limits - virtually every subdivision in Katy south of I-10, except WoodCreek Reserve, are NOT in the city limits and thus not subject to this tax.  (City Limits of Katy: http://cityofkaty.com/how-do-i/what-is-the-city-limits-of-katy/

Also, many providers do not list this tax separately - they lump of the taxes and PUC charges into one line item so customers may not be aware they are being charged this fee.

Here's a good link from a law group that talks about it this tax...
