Realtor BrandingAlthough I believe I am your local REALTOR® in Fairfield New Jersey, I am not allowed to say it, write it or admit it but you can brand it in a different way.

Just yesterday I received my 2010-2011 Membership Reference Guide from the National Association of REALTORS®.  As we know REALTORS®are bound by many things, one of the most important is NAR's Code of Ethics.  With that being said, I started flipping through the pamphlet and I came across the "The REALTOR® Brand" which talks about the REALTOR® brand being a powerful marketing tool, valued at over $3 billion.

Realtor It goes on to mention how the REALTOR® brand must be used properly, starting with these important rules:

  • REALTOR® may be used in conjunction with a member's name or the name of a member's brokerage firm. (ex. Weichert Realtors®)
  • REALTOR®is not an occupation or a generic term synomymous with "real estate agent" and should never be used as such. (ex. Gina Chirico, Sales Associate NOT Gina Chirico, REALTOR®)
  • REALTOR® may not be modified by descriptive words or phrases such as "your", "local" or "Chicago". (ex. Your REALTOR® of Choice for Whitestone Gardens)

Branding yourself as the local RealtorThe reason why the section "The REALTOR® Brand" caught my attention and what prompted me to write this post is because I was unaware of the third bulletpoint......"REALTOR® may not be modified by descriptive words or phrases such as "your", "local" or "Chicago"."

Many, if not all of my Whitestone Gardens posts, branded me as Your REALTOR® of Choice for Whitestone Gardens.  Last night I went through my posts for Whitestone Gardens and removed the wording Your REALTOR® of Choice

Local Realtor BrandingThere are many other ways to brand yourself as the local REALTOR® by not using a reference or tagline which is prohibited by NAR.  Servicing your buyers and sellers, writing about your local town and/or communities, putting yourself in the center of your community NOT by writing about yourself but about writing about the community, real estate market, schools, etc.  Remember if you brand yourself as the local REALTOR® in your area using different ways, there's no reason why you would need to say it or write it because they WILL ALREADY KNOW.

Well I know that I am not a Realitor! But I did go the Docitor for a checkup. You always can tell some one new in the business by the way that pronounce Realtor.

Thanks for a great article.  We as realtors, Realtors, REALTORS, REALTOR®s have so much information to keep track of and read that sometimes the most basic guidelines are forgotten. We need one of those 24/7/365 hotlines to fact check and stay compliant.

Hmm, better run off and check all my marketing materials now, business cards, auto wrap, website...

I'm glad you changed your advertising. We have a  REALTOR® in our area (and right here on AR) who uses "Your REALTOR® of choice"- it bothers me every time I see it. She also has a web site that proposes to be the MLS for our town (also a violation).

It isn't hard to understand the rules- NAR says the only way we are supposed to use REALTOR® is to designate that we belong to NAR, as opposed to just being a RE agent, NOT with any words that say we are a better REALTOR® than others.

A lot of agents violate that 3rd rule but few of us, if any, would report it as a violation.  I think the reason they put that in there is to prevent any one Realtor from dominating at the expense of others.  An agent with enough advertising dollars would probably overrun others with a few ads and such a tagline.  I see plenty of agents in the Silicon Valley area using similar taglines.

Gina great post, i have had my run in with Realtor trademarks. I persoanlly hope they finally go down as far as having a trademark for realtor because the public does not think it means they are members of an association, they think it means real estate agent as a generic term and I would be happy to see this generic term un trademarked. It will happen soon enough.

I still don't believe it makes all the difference with buyers and selles. All sellers ask is whether or not their listing is going in the MLS. Buyers, don't ask anything related to whether an agent is a REALTOR or not. Whether they just assume he/she is, may be true. But, I really don't think an ordinary citizen really cares.

Look at some o fthe comments here. The word REALTOR must ALWAYS be capitalize and yet many agents do not adhere to this requirement. And, yes, the circled R is also a part. You certainly can capitalize the word...and in your word processing program you can insert a circled R...

When I saw the website a few years back: "I Hate Realtors.com" . . .  yeah, I can see where the NAR might want to safeguard their trademark.  But, I see a lot of Realtors(r) -- even here on AR -- use it similar to how you are / were.

NAR may be creating a problem for themselves by over-regulating the term REALTOR(R).  If they make it a hassle to use agents won't use it, thus diminishing exposure of NAR and all the good things it stands for.

This is a good and valuable post. What got me is the price of the word: ".. The REALTOR® Brand" which talks about the REALTOR® brand being a powerful marketing tool, valued at over $3 billion..." Who would buy that one word for that much money? is it really worth that much? We need to collect some royalties then, since WE, real estate agents, are the ones that promote it.

Unfortunately, NAR is so bad about policing bad agents, or helping us police them, that I would hope they would not spend time going after an agent that put:  John Doe - REALTOR® while there are people out there stealing customers, misrepresenting themselves on the internet, bad mouthing other agents, etc. I have seen agents spell REALTOR as Realtor, most do not put in the trademark symbol. Those are minor issues and do nothing to diminish the reputation of the brand. The other infractions I mentioned, and many others, do!

WOW - thanks everyone for all your comments.  I have read each and every one of them.  I'm glad to see that others realize and appreciate the point I was making with the trademark.

I have reached out to the NAR trademark department and asked them.  If and when I get a reply, I will update everyone.

Huh?  Do we really have time for this?  Have we not ALL paid the "price of admission" to the "Club".  If the NAR "Realtor Police" ever show-up at my door to complain about such nonsense, I'll know it's finally time to pack-it-in.  This organization has many more Pressing issues with which to deal than wasting their efforts on the proper use of the term REALTOR.
