RANT! - Currently, BP is not paying claims to Realtors - 06-22-2010

I am a realtor in Destin, Florida and like many other agents, I have been affected financially by the oil spill.  I have encountered canceled contracts from buyers and new contracts have slowed down to a snail's pace.  I have emails stating that the buyers canceled because of the oil spill.  To tell you honestly, I do not blame them for canceling.  Transactions have slowed and there will be many more buying opportunities over the next 90 days.  BP has caused this mess, BP has damaged our real estate market, and BP IS NOT PAYING CLAIMS TO REALTORS.  When you go in and file a claim they will tell you that "no claims are ever closed".    My representative told me that BP was analyzing the situation and no checks were being cut to realtors.  They did pay a few in the beginning but this has stopped.

BP is paying the claims that benefit them politically.  If you are a fisherman, you will get paid.  Fishermen deserve to get paid, but what about all of the small businesses, Realtors, rental companies, etc, etc, that are affected by this spill.  BP has killed our season and affected all of us on the gulf coast.  I find it amazing that they are not processing claims for realtors but this is what I was told by the BP adjuster last week.  I will update this blog the second things change.

I stopped by the claim center when I had my first cancellation and they were very nice;  They assured me that  "BP had plenty of money",  and they would pay claims quickly.  Real Estate in Destin Florida has slowed down and BP needs to pay claims for canceled contracts and lost revenue.  If anyone gets fed up, you can hire an attorney.  Below is the link to a law firm that specializes in this type of litigation.

I hope that BP will take responsibiltiy and clean up this mess.  Currently our beaches are still beautiful with the exception of a few tar balls but the financial damage has been done and it is a shame because Destin, Florida real estate was in a recovery mode and BP shut this down.

UPDATE - 07/16/2010

A BP Rep called me last week and told me he was paying me a claim for my 3 cancelled contracts.  I was so ready to write something positive in my blog.  I called him everyday to follow up and yesterday he told me "BP has placed a hold on paying claims to realtors again".  THANKS BP!  I speak with alot of business owners and I have not heard of one person to say anything positive about BP and the claims process.  They are not doing what is right.

 

UPDATE - 10/01/2010

I just received a partial payment of $12,000 on my claim.  It seems that BP is beginning to cut checks.  This is a good start.

WOW, I'm not sure how I feel about this? Are sales only down in that area? Or are sales down on the Atlantic Coast? If so then maybe its a market thing? Just asking?

Chris - Most of the cancellations I have seen are due to the oil spill.  The rental cancellations are even worse.  When the news reports doom and gloom on the coast, we are definitely affected.

Clayton - Thank you for bravely posting this!  I was going to call you - will do.  Did my first claim on Friday, heard the rumors.  Abysmal!  We might want to write to Kenneth Feinberg, the new overseer of the claims process.  Let's get the ball rolling.  I'm ready!

Wendy - Thanks for your comments!  I felt that this needed to be shared.  I have been in business many years and if I make a mistake, I make it right and I pay the price.  It is called good business.  I know we are on the same page.

Just so you know its not jsut realtors.  They are not paying commision based jobs at all.  I too got a small check in the beginning but now Im being told that they are trying to come up with a plan on how to pay commision based people.

Im in boat sales....hmmm you think that the oil spill has an affect on my income. Whats even more frustrating is the adjuster told me that I have all the documents he needs, I deserve to be paid, and it clear that I am down due to whats going on.  Right after he tells me that he says " but there is nothing I can do until they say I can write you a check, sorry check back tomorrow "

What about the Owners who had their property for sale prior to the spill. My condo has been on the market for over 24 months. I finally got a buyer interested and as I was literally waiting by the fax for an offer my Broker called and informed me the buyer was on hold until the BP oil spill issue was resolved. As of Monday she said the buyer was no longer in the market.

I need that $142,000 to pay off my Mortgage or I am  going lose it to the bank.

I have a claim but no answers from BP.

I cant rent it none of the rental agencies will even take it in their programs because they cant rent what they have and I cant give it away. So its value because of BP is $0

Just thought I would add to this. I live in Alabama and we have a small residential trim business for new houses. Thay are not paying those claims either. They told us it was due to them not having the guidelines on how to pay us. Meanwhile we are looking at bankruptcy and the fact that there are no other jobs here.

OK!  I am happy to report that I have received a partial payment on my claim.  This is a good start.

I had been working in the mortgage business as loan advisor in the Destin area for over a year.  99% of my business was local and tons of referral.  The company I worked for laid everyone off 1 month after the spill and I have not been able to attain gainful employment since to match what I was making.  I filed my BP claim at the beginning of October and my claim has now been denied because I couldnt show loss of profits!!  Well lets see I lost my house, car and other valuables over the summer while unable to get even a serving job!!  So how is it BP can NOT pay real estate/mortgage indivuduals for all of there loss?  I had 4 homes cancel their purchase transactions in May not to mention this company lost so much $$ they have yet to pay me my last check!!  If anyone has anything to add regarding my specific occupation, I would love to have your feedback!!
