HAFA Short Sale Eligibility Requirements

Who Is Eligible For HAFA?

In order to participate in HAFA (Home Affordable Foreclosure Alterntatives) certain criteria must be met.  First and foremost the lender/servicer must be participating in the HAFA program.  Click Here to determine if your mortgage lender is participating in the HAFA program.

Homeowner Eligibilty

1. Does not qualify for HAMP Loan Modification Trial Period Plan, or...

2. Does not successfully complete HAMP Trial Period Plan, or...

3. Is delinquent on a HAMP permanent modification by missing at least two consecutive payments, or... 

4. Homeowner requests a short sale. 

Mortgage/Property Eligibilty

1.  Must be the homeowner's primary residence.

2. The mortgage must be a first lien that was originated before January 1st, 2009.

3. The mortgage must be either currently delinquent or default must be reasonably foreseeable.

4. The current principal balance of the mortgage must be equal or less than $729,750.00.

5. The current monthly mortgage payment must exceed 31% of the homeowner's gross monthly income.

Dear Dave,

How long does the seller have to stay in the home during escrow per HAFA guidelines? 

And, if they move out early is there a penalty?
